Sec. 31.90. - Minimum height.¶
No person owning or having control or possession of any building or structure in the city, shall construct, or maintain, or permit to be constructed or maintained any awning or canopy extending or projecting into any public street or over any public sidewalk within the city unless all parts of such awning or canopy shall be not less than six and one-half (6½) feet above such street or sidewalk, as the case may be.

Sec. 31.91. - Violations of article declared a nuisance; notice to abate.¶
All awnings now existing or which may hereafter be constructed in contravention of the provisions of this article are hereby declared to be a nuisance, and it shall be the duty of the chief of police to give notice to all persons who shall construct or maintain, or permit to be constructed or maintained, any awning or canopy not complying with the provisions thereof, to abate such nuisance.

Sec. 31.92. - Failure to abate violations upon notice.¶
Any person who shall have received notice to abate such nuisance as provided in the preceding section, and shall neglect or refuse to abate the same within three (3) days from and after such notice, shall be guilty of a misdemeanor. Each and every date of such neglect or refusal shall constitute a separate and distinct offense.

Sec. 31.93. - Abatement by chief of police upon failure of person receiving notice.¶
Whenever any person constructing or maintaining a nuisance as provided in section 31.91 shall receive notice to abate the same, and shall have neglected or refused to abate the same for a period of more than three (3) days from and after such notice, it shall be the duty of the police chief to abate such nuisance.
