Sec. 31.31. - Certain structures prohibited less than two feet below surface.¶
No person shall install, or cause or permit to be installed, any service pipe or main pipe, conduit, duct, tunnel or other structure, except manholes, culverts and catch basins, in any public street, or alley, or other public place, less than two (2) feet below the surface of such public street, or alley or other public place.

Sec. 31.32. - Maps—Required generally.¶
It shall be the duty of every person owning, using, controlling or having an interest in pipes, conduits, ducts or tunnels under the surface of any public street, alley, sidewalk or other public place, for supplying or conveying gas, electricity, water, communication lines, steam or oil in, to or from the city to or from its inhabitants, or for any other purpose, by May 14, 1948, to file in the office of the street superintendent a map or set of maps, each drawn to a scale of not less than two hundred (200) feet to one inch, which map shall show in detail the exact location, size, description and date of installation, if known, of all mains, laterals, services and service pipes, and of all valves, pressure regulators, drips, manholes, handholes, transformers, chambers or other appliances installed beneath the surface of the public streets, alleys, sidewalks or other public places in the city, belonging to, used by or under control of such person or in which such person has any interest.

Sec. 31.33. - Same—Corrections.¶
It shall be the duty of every person to file within thirty (30) days after the first day of January of each year, in the office of the street superintendent, a corrected map or set of maps, each drawn to a scale of not less than two hundred (200) feet to once inch, showing the complete installation of all such pipes and other appliances, including all installations made during the previous year to and including the last day of such year.

Sec. 31.34. - Same—Affidavit.¶
Each map filed pursuant to the provisions of this article shall be accompanied by an affidavit endorsed thereon, subscribed and sworn to by such person, or by a member of such firm, or by the president or secretary of such corporation, to the effect that the same correctly exhibits the details required by this article to be shown thereon.

Sec. 31.35. - Same—Scope.¶
Each map or set of maps filed pursuant to the provisions of this article shall show in detail the location of all such pipes, conduits, ducts, tunnels or other structures abandoned subsequent to the filing of the last preceding map or set of maps.

Sec. 31.36. - Filing statement of abandoned structures.¶
Whenever any pipe, conduit, duct, tunnel or other structure located under the surface of any public street, alley or other public place, or the use thereof, is abandoned, the person owning, using, controlling or having an interest therein shall, within thirty (30) days after such abandonment, file in the office of the street superintendent a statement in writing giving in detail the location of the pipe, conduit, duct, tunnel or other structure so abandoned.

Sec. 31.37. - Applicability of article—To work performed pursuant to state law.¶
None of the provisions of this article shall apply to any work done or to be done in, along or upon any public street, alley or other public place pursuant to any law of the state providing for the improvement thereof or to any work done or to be done in, along or upon any such street, alley or other public place pursuant to any contract for the improvement authorized by the city council.

Sec. 31.38. - Same—To work performed by certain officers or employees.¶
The provisions of this article shall not apply to excavations made by any employee or official of the street or water departments for the purpose of repairing or maintaining streets or sewers.

Sec. 31.39. - Same—To work performed by public utility company pursuant to franchise.¶
The provisions of sections 31.6 to 31.15 shall not apply to excavations made by any public utility company pursuant to the provisions of a franchise granted by the city.

Sec. 31.40. - Same—To necessities.¶
Nothing in this article contained shall be construed to prevent any person maintaining any pipe or conduits in any public street, alley or other public place by virtue of any laws, ordinances or permits from making such excavations as may be necessary for the preservation of life or property when such necessity arises during such hours as the offices of the city are closed; provided, that the person making such excavation shall obtain a permit therefor within four (4) hours after the offices of the city are first opened subsequent to the making of such excavation.

Sec. 31.41. - Applicability of article provisions relative to maintaining crossings,…¶
The provisions contained in section 31.16 shall apply to all such work, and to all excavations to be made in, along or upon any public street, alley or other public place.
The provisions contained in this article shall apply to all such work and to all such excavations made or to be made in, along or upon any public street, alley or other public place whenever the specifications for such work so provide.
