Before a building permit may be issued to any applicant intending to use a portion of the public right-of-way for storage of construction material including sand and gravel, equipment, construction buildings or sanitary facilities, an encroachment permit must be obtained from the superintendent of streets of the City of Oceanside.

The superintendent of streets shall determine the extent to which the street is to be used and the safety precautions to be taken by the applicant, including traffic-control devices and barricades.

The encroachment permit shall state the extent of the encroachment allowed and any requirements placed upon the applicant.

The encroachment permit may be revoked if the permittee fails to abide by and perform all conditions and requirements placed upon permittee pursuant to the issuance of said permit.

It shall be unlawful for any person to obstruct the public right-of-way by placing construction materials, equipment or appurtenant devices thereon unless an encroachment permit has been previously obtained from the superintendent of streets of the City of Oceanside.
