Sec. 31.1. - Datum plane established.¶
The mean sea level, as set forth in List No. 197-California, dated November 30, 1949, and issued by the United States Coast and Geodetic Survey, is hereby fixed and established as the official "datum plane" for all works and improvements of the city.

Sec. 31.2. - Bench marks.¶
The official bench marks are hereby established as being a brass plate at locations and elevations as follows:
(a) United States Coast and Geodetic Bench Mark "R". On the northwest side of Third Street between Tremont and Hill Street, embedded in the wall of the south corner of a store building, a standard disk stamped "R 1906" set vertically, is elevation 64.390 feet.
(b) United States Coast and Geodetic Bench Mark "A 64". At the corner of Cleveland and Mission Avenue, at the northeast corner of The Atchison, Topeka and Santa Fe Railway Park, and 100 feet east of the station a standard disk, stamped "A-64 1927" and set in the top of a concrete post, is elevation 47.428 feet.
(c) United States Coast and Geodetic Bench "B 64". At the end of Third Street, and in the middle stud of the concrete pier at Oceanside Beach a standard disk, stamped "B 64 1927," is elevation 44.344 feet.
(d) United States Coast and Geodetic Bench "H 131". 1.7 miles southeast along The Atchison, Topeka and Santa Fe Railway from Oceanside, at the second pole northwest of mile post 228, at a street crossing, 45 feet east of the centerline of the track, and 43 feet north of the centerline of Cassidy Street a standard disk, stamped "H-131 1933" and set in the top of a concrete post, is elevation 38.697 feet.
(e) United States Coast and Geodetic Bench Mark "Y 63". 2.2 miles northeast along the Oceanside Highway from Oceanside, at the foot of a hill leading out of San Luis Rey Valley, at a turn south, 36 feet west of the centerline of the highway, and near a power pole (in city water department yard ) a standard disk, stamped "Y 63 1927" and set in the top of a concrete post, is elevation 35.495 feet.
(f) United States Coast and Geodetic Bench Mark "P 131". One mile southwest along the Oceanside Highway from the post office at San Luis Rey, 29 feet north of the centerline of the highway, 16 feet east of the centerline of a road leading to a farmhouse, a standard disk, stamped "P 131 1933," and set in the top of a concrete post, is elevation 39.097 feet.
(g) Oceanside Bench Mark No. 1. Located on walkway of bridge crossing San Luis Rey River on U.S. 101 Freeway, at the northeast corner, a brass plate marked "City of Oceanside B.M. No. 1," is elevation 64.920.
(h) Oceanside Bench Mark No. 2. Located on abutment of overpass at Eighth Street, southeast corner, at end of guard rail, a brass plate marked "City of Oceanside B.M. No. 2," is elevation 116.218.
(i) Oceanside Bench Mark No. 3. Located on Mission Avenue in front of the state highway patrol office, set on top of cleanout box for storm drain on division strip between main road and off-ramp from San Diego, brass plate marked "City of Oceanside B.M. No. 3," is elevation 130.947.
(j) Oceanside Bench Mark No.4. Located on abutment of bridge, northwest corner, at end of guardrail, on the Brooks Street overpass, a brass plate marked "City of Oceanside B.M. No. 4," is elevation 132.896.
(k) Oceanside Bench Mark No. 5. Located at northwest corner of bridge, on the abutment, at end of guardrail, such bridge being on the U.S. 101 Freeway and crossing the A.T. & S.F. Railway, Escondido Branch, and also Short Street, a brass plate marked "City of Oceanside B.M. No. 5," is elevation 53.267.
(l) Oceanside Bench Mark No. 6. Located at southeast corner of bridge, on the abutment at end of guardrail, such bridge being the California Street overpass on the U.S. 101 Freeway, a brass plate marked "City of Oceanside B.M. No. 6," is elevation 102.131.
(m) Oceanside Bench Mark No. 7. Located on Cassidy Street overpass on the freeway at northeast end, on the abutment at end of the guardrail, a brass plate marked "City of Oceanside B.M. No. 7," is elevation 92.952.
(n) Oceanside Bench Mark No. 8. Located on walkway of bridge at southeast corner, on Hill Street, crossing Loma Alta Creek, a brass plate marked "City of Oceanside B.M. No. 8," is elevation 11.768.
(o) Oceanside Bench Mark No. 9. Located on east end of curb return at southeast corner of Hill and Wisconsin Streets, near the stop light, a brass plate marked "City of Oceanside B.M. No. 9," is elevation 60.051.
(p) Oceanside Bench Mark No. 10. Located on top of retaining wall at the northeast corner of Third And Ditmar, a brass plate marked "City of Oceanside B.M. No. 10," is elevation 81.556.
(q) Oceanside Bench Mark No. 11. Located at the sidewalk intersection in front of South Oceanside Fire Station, northeast corner of Ditmar and Cassidy Streets, a brass plate in a six-inch concrete monument marked "City of Oceanside B.M. No. 11," is elevation 49.298.

Sec. 31.3. - Damaging, etc., pavement, etc., generally.¶
No person shall negligently, wilfully or maliciously dig up, remove, displace, break down or otherwise injure or destroy any public street, alley, sidewalk, bridge or other public place.

Sec. 31.4. - Use of vehicles with cleats, etc.¶
No person shall drive or cause to be driven thereon any drawn vehicle or machinery or motor vehicle, having lug-type wheels or wheels of any kind or nature which would cause damage to the roadway.

Sec. 31.5. - Flooding streets, etc.¶
No person shall negligently, willfully or maliciously drain, divert or in any manner permit, by seepage, overflow or otherwise, any waters thereunto or thereon from lands lying adjacent to or in the vicinity of such public street, alley, sidewalk, bridge or other public place.
