Sec. 2.37. - Created.

There is hereby created and established a planning commission for the city.

Sec. 2.38. - Appointment of members; terms; vacancies.

The planning commission shall consist of seven (7) members all of whom shall be residents of the city. Planning commissioners shall be appointed by the majority vote of the city council. The term of appointment of a planning commissioner shall be four (4) years. Each member of the planning commission shall hold office until the expiration of their respective term and until a new member has been duly appointed. If a vacancy shall occur otherwise than by expiration of the term, it shall be filled by appointment by a majority vote of the city council for the unexpired portion of the term. The terms of the various planning commission offices shall be staggered according to the schedule established by ordinance code § 9212. Any member of the city council may nominate candidates for planning commissioner.

Sec. 2.38.1. - Removal of members of the planning commission.

The provisions of section 2.38 notwithstanding, a member of the planning commission may be removed, at any time, by a majority vote of the city council.

Editor's note— Ord. No. 72-27, § 1, amended Ch. 2, Art. VII, by adding § 2.38.1 Sec. 2 of said Ord. No. 72-27 provided:

Charter reference— "Section 2. The members of any commissions, which have been established by resolution or ordinance or other action of the city council of the City of Oceanside, may be removed, at any time, by a majority vote of the city council."

Sec. 2.39. - Powers and duties generally.

(a) The planning commission shall have all the powers, rights and duties provided and given to the city planning commission under and by virtue of the laws of the state.

(b) The planning commission shall also perform such other functions as may be assigned by the city council.

Sec. 2.40. - Promulgation of rules and regulations; officers; records.

The planning commission shall make and adopt its own rules and regulations for its organization and procedure consistent with the laws of the state. Such rules and regulations shall be reduced to writing and be on file with the secretary of the planning commission and the city clerk at all times. It shall appoint such officers as may be necessary and shall keep an accurate record of all of its proceedings and transactions.

Sec. 2.41. - Appointment of committees and hearing officers.

The commission may appoint committees or hearing officers to hear matters on which testimony must be taken, which committees or officers shall report to the commission the findings and results of any such hearing on a matter referred to such committee or person.
