6-40 Amendment Of Uniform Codes With Respect To Appeals Boards

This article shall apply to any appeal boards referenced in any of the Uniform Codes adopted by reference by this chapter and shall supersede the provisions of the Uniform Codes to the extent that those provisions are inconsistent with this article. (Ord. No. 423-AC, (part).)

6-41 Planning Commission Is Appeals Board

The appeals board for each Uniform Code shall be the planning commission. Proceedings before the planning commission shall comply with the provisions of the respective Uniform Code. The decision of the planning commission shall be final unless appealed to the city council. The manner and timing of an appeal to the city council shall be the same as that specified in the Uniform Code for an appeal to the planning commission.

6-42 Setting The Hearing For The City Council

Within thirty days of receipt of an appeal to the city council, the city council shall set the matter for hearing. The hearing date shall be not less than ten days, nor more than sixty days, from the date of the city council meeting in which the hearing is set. Written notice of the hearing shall be given at least ten days before the hearing. (Ord. No. 423-AC, (part).)

6-43 Hearing Before The City Council

At least five days before the hearing, any interested person may file written comments or exceptions to the report and decisions of the planning commission. The city council shall consider the report of the planning commission and any written comments or exceptions thereto. At the hearing of the matter, the city council may, but is not required to, hear statements of interested persons, including the appellant(s) and the city staff. The city council may accept, reject or modify the decision of the planning commission. (Ord. No. 423-AC, (part).)
