13-91 Cost Recovery Fee For Certain Stored Vehicles
- The registered owner or other lawful possessor of any automobile stored by the Needles police department and/or City of Needles code enforcement officers, pursuant to California Vehicle Code Section 22651 (h), 225619 (k), 22651 (o) or 22651 (p), shall be required to pay an administrative fee to the city in an amount set by resolution of the city council, prior to said department’s providing a written release of such stored vehicle.
- This cost recovery fee shall be sued to reimburse the city for the costs of the special services of its police officers and administrative personnel in processing stored vehicle releases, and shall not exceed the actual cost of providing such special services.
- The registered owner or other lawful possessor of any stored vehicle subject to the provisions of this article may request and shall be provided a post-storage hearing pursuant to California Vehicle Code Section 22852. Following the conclusion of such hearing, if it is determined that the vehicle was invalidly stored, the aggrieved owner or lawful possessor thereof shall be refunded the reasonable cost of storage and the administrative fee imposed hereby.
