It is hereby determined upon the basis of an engineering and traffic investigation that the speed permitted by state law upon the following streets is less than is necessary for safe operation of vehicles thereon by reason of the designation and sign posting of such streets as through highways or by reason of widely spaced intersections, and it is hereby declared that the prima facie speed limit shall be as set forth in this section on those streets or parts of streets designated when signs are erected giving notice thereof: (None designated). 13-29 Decrease Of Prima Facie Speed Limits

It is hereby determined upon the basis of an engineering and traffic investigation that the speed permitted by state law outside of business and residence districts as applicable upon the following streets is greater than is reasonable or safe under the conditions found to exist upon such streets, and it is hereby declared that the prima facie speed limit shall be as set forth in this section on those streets or parts of streets designated when signs are erected giving notice thereof are designated below. 13-30 Decrease of State Law Speed Between Districts

Reference is hereby made to the following portions of streets where the state speed law of fifty-five miles per hour is applicable for a distance of not exceeding two thousand feet in length between districts, either business or residence, and it is hereby determined upon the basis of an engineering and traffic investigation that the speed permitted by state law upon the following described portion of such streets which are not state highways is greater than is reasonable or safe under the conditions found to exist upon the described portions of such streets, and it is hereby declared that the prima facie speed limit shall be as set forth in this section on those portions of streets designated when signs are erected giving notice thereof: (None designated). 13-30.1 Speed In School Zones

  1. Pursuant to Vehicle Code Section 22352(a)(2)(B), speed limits in school zones are set at twenty-five miles per hours while children are going to or leaving the sc school hours or during the noon recess period.

Whenever any street or alley is designated as any one-way street or alley, the city traffic engineer shall place and maintain signs giving notice thereof, and no such regulations shall be effective unless such signs are in place. Signs indicating the direction of lawful traffic movement shall be placed at every intersection where movement of traffic in the opposite direction is prohibited.

In accordance with this section, and when properly signposted, traffic shall move only in the direction indicated upon the following streets:

13-32 Turning Movements

  1. Whenever authorized signs are erected indicating that no right or left or U-turn is permitted, not driver of a vehicle shall disobey the directions of any such sign.
  2. When authorized markers, buttons or other indications are placed within an intersection indicating the course to be traveled by vehicles turning thereat, no driver of a vehicle shall disobey the directions of such indications.
  3. The city traffic engineer is hereby authorized to determine those intersections within any business or residence district at which drivers of vehicles shall not make a right turn against a red or stop signal and shall erect proper signs giving notice of such prohibition. 13-33 Through Streets And Stop Intersections

  1. Whenever this chapter or any other ordinance of the city designates and describes any street or portion thereof as a through street, or any intersection at which to stop at one or more entrances thereto or any railroad grade crossing at which vehicles are required to stop, the city traffic engineer shall erect and maintain st

A stop sign shall be erected on every street intersecting such through street or portion thereof so designated, and at those entrances of other intersections where and at any railroad grade crossing so designated. Every such sign shall conform with and shall be placed as provided in Sections 21352, 21354 and 21355 of the V state. 2. When stop signs are erected as provided in this section at the entrance to any intersection or any railroad grade crossing, every driver of a vehicle shall stop as re Vehicle Code of the state. 3. In accordance with the provisions of this section, and when signs are erected giving notice thereof, drivers of vehicles shall stop before crossing the railroad trac railway grade crossings described as follows: All traffic going north or south on River Street is required to stop at the intersection of such street and the Santa Fe Railroad track.

13-33.2 Same -- "D" Street And Cibola That in accordance with the provisions of Vehicle Code No. 21354, said city council designates the intersection of “D” Street and Cibola in said city as a stop intersection and directs the placement and maintenance of a stop sign placed on the northwest corner of said intersection. 13-34 Truck Routes 13-34.1 Transportation Permit

13-34 Truck Routes

  1. Whenever this chapter designates and describes any street or portion thereof as a street the use of which is permitted by any vehicle exceeding a maximum gros tons, the city traffic engineer is hereby authorized to designate such street or streets by appropriate signs as “Truck Traffic Routes” for the movement of vehicles gross weight limit of three tons.
    1. Whenever any such truck traffic routes are established and designated by appropriate signs the operator of any vehicle exceeding a maximum gross weight limit drive on such routes and none other, except when necessary to traverse another street to a destination for the purpose of loading or unloading, but then only by nearest truck route as is reasonably necessary. The provisions of this section shall not apply to passenger buses under the jurisdiction of the state public utilities
    2. In accordance with this section, and when signs are erected giving notice thereof, the following streets or portions of streets are hereby declared to be truck traff movement of vehicles exceeding a gross weight of three tons: (None designated). (Ord. No. 257 N.S.)

13-34.1 Transportation Permit

  1. No person shall operate or move a vehicle or combination of vehicles or special mobile equipment of a size or weight of vehicle or load exceeding the maximum of California Vehicle Code on any highway or street within the City Limits of Needles without first obtaining a transportation permit from the city engineer or hi
    1. The type of permit may be single trip or annual.
    2. The city engineer is authorized to issue or withhold any permit at his/her discretion. If the permit is issued, he/she is authorized to limit the number of trips or t or time and day limitations or designate certain routes within the City of Needles, which the vehicle or vehicles described may be operated on the highways and otherwise to limit or prescribe conditions of operation of vehicle, when necessary to assure against undue damage to the road foundations, surfaces or structure the undertaking of other security as may be deemed necessary to protect the highways, streets and bridges from injury or to provide indemnity for any injury res operation of the vehicle.
    3. It is unlawful for any person to violate any of the terms or conditions of the transportation permit.
    4. The permit application fees shall be the same as those in use by the California Department of Transportation. Additional services necessitated by unusually large such as engineering investigations, police escorts, utility escorts or other services, shall be billed separately for each permit.
    5. Nothing in this section shall relieve the operator or driver from any obligation imposed by federal, state or local laws relating to this type of transportation.
    6. Any person convicted of transporting an extralegal load on a highway, or causing or directing the operation of or driving on a highway any vehicle or combinatio which a permit is required pursuant to this article, without having obtained a permit issued in accordance with this article, shall be punished by a fine not excee dollars ($500) or by imprisonment in the county jail for a period not exceeding six months or by both such fine and imprisonment.

13-35 Use of Certain Streets By Commercial Vehicles Prohibited

Whenever this chapter designates and describes any street or portion thereof as a street the use of which is prohibited to any commercial vehicle, the city traffic en and maintain appropriate signs on those streets affected.

The provisions of this section shall not apply to passenger buses under the jurisdiction of the state public utilities commission.

In accordance with this section, the following streets and parts of streets are hereby declared to be streets the use of which is prohibited by any commercial vehicles o pounds gross weight (except school buses and city vehicles) and subject to the exceptions of Section 35701 and 35703 of the Vehicle Code of the State: "O" Street, b Market Streets. Market Street, between "N and "P" Streets. Third Street, between "J" and "C" Streets.

  1. Whenever this chapter designates and describes any street or portion thereof as a street the use of which is prohibited to any oversized vehicle, the city traffic engineer shall erect and maintain appropriate signs on those streets affected.
  2. The provisions of this section shall not apply to passenger buses under the jurisdiction of the state public utilities commission.
  3. In accordance with this section, the following streets and parts of streets are hereby declared to be streets the use of which is prohibited by any oversized vehicle over six thousand pounds gross weight (except school buses and city vehicles) and/or eight (8) feet tall and subject to the exceptions of sections 35701 and 35703 of the Vehicle Code of the state: Third Street, between J and C Streets. North K Street, between Needles Highway and Front Street. Chestnut Street, between West Broadway and North K Street. Walnut Street, between West Broadway and North K Streets. M Street, between Needles Highway and Spruce Street. N Street, between Needles Highway and Spruce Street.
  4. Exceptions. The provisions of this section shall not apply to trucks performing local deliveries or local pick-ups to or from destinations located on the restricted streets, provided no reasonable alternative route exists; trucks owned or operated by a public utility, public agency, or municipality engaged in construction, maintenance, or emergency operations; emergency vehicles as defined California Vehicle Code section 165; transit vehicles, including buses operated by public transit agencies; or garbage collection, postal service, and other essential municipal service vehicles.

13-35.2 Oversized Vehicles Prohibited From Parking On The Streets Identified In Sec 13.35.1(c), Residential Streets And City Parks.

Commercial trucks over twenty six thousand (26,000) pounds gross vehicle weight rating (GVWR) (except school buses and city vehicles) are prohibited from parking on the streets identified in Sec 13.35.1(c), any residential street within the City as designated in the City of Needles Transportation Element, as it may be amended from time to time, and City parks.

13-35.3 Signage

Appropriate signage indicating the truck restrictions in this section shall be installed by the City at locations deemed necessary by the City to provide notice to drivers, in accordance with Caltrans and California Manual on Uniform Traffic Control Devices (CA MUTCD) standards. Enforcement of the prohibition shall commence upon installation of said signage.

13-35.4 Violation - Penalty

In the discretion of the Enforcement Officer or designee identified by the City Manager, any person violating the provisions of Sections 13-35.1 and 13-35.2 shall be issued an administrative citation or a citation for a misdemeanor pursuant to Needles Municipal Code section 2A-04. The following specific fines shall apply:

  1. A fine of five hundred dollars ($500) shall be imposed for the unauthorized parking of any commercial vehicle in a location not designated for commercial vehicle parking and/or on a roadway that is not an authorized truck route, in violation of this Chapter.

13-36 Emerging From Alleys, Driveways, Etc.

The driver of a vehicle emerging from an alley, driveway or building shall stop such vehicle immediately prior to driving onto a sidewalk or into the sidewalk areas extending across any alley way.

All traffic emerging from any alley in the city shall stop at the intersection of such alley and any street. (Ord. No. 257 N.S.)

13-37 Driving Through Funeral Processions

No driver of a vehicle, except an emergency vehicle, shall drive between vehicles comprising a funeral procession while there are in motion and when the vehicles in such procession are conspicuously so designated. (Ord. No. 257 N.S.)

13-38 Driving On Sidewalks

The driver of a vehicle shall not drive within any sidewalk area or any parkway, except at a permanent or temporary driveway. (Ord. No. 257 N.S.)

13-39 Driving Over New Pavement, Closed Streets, Etc.

No person shall ride or drive any animal or any vehicle over or across any newly made pavement or freshly painted marking in any street, when a barrier or sign is in place warning persons not to drive over or across such pavement or marking, or when a sign is in place stating that the street or any portion thereof is closed. 13-40 Restrictions On Use Of Freeways And Restricted Access Roadways

  1. No person shall drive a vehicle onto or from any limited access roadway, except at such entrances and exits as are established by public authority.
  2. No person shall drive or operate any bicycle, motor driven cycle or any vehicle which is not drawn by a motor vehicle upon any street established as a freeway, as defined by section 21960 of the Vehicle Code of the state, nor shall any pedestrian walk across or along any such street so designated and described, except in space set aside for the use of pedestrians; provided, that official signs are in place giving notice of such restriction. 13-41 Repealed By Ord No 231-AC

13-42 Racing, Contests, Etc., Prohibited

No person while operating any automobile, motorcycle or other motor vehicle, either upon the public streets or anywhere else within the city, shall engage in any race, contest or game of “follow the leader,” “hare and hound” or any other similar game or contest. (Ord. No. 257 N.S.)
