2.25.010 - Purpose.¶
The purpose of this chapter is to establish a system for the registration of weighing and measuring instruments and to recover the cost of inspecting and testing such instruments, as provided by Business and Professions Code Section 12240, et seq.

2.25.020 - Definitions.¶
For the purpose of this chapter, and unless the text otherwise requires, the following terms and phrases shall have the following definitions:
A. "Commercial purposes" shall have the meaning assigned to it by Section 12500 of the Business and Professions Code.
B. "County sealer" means the sealer appointed by the board of supervisors and his/her duly authorized agents.
C. "Location" means the room, enclosure, building, space or area where one or more weighing and measuring instruments are located or operated.
D. "Weighing and measuring instruments" means and includes all weighing and measuring devices required to be tested by the county sealer pursuant to Business and Professions Code Section 12210.

2.25.030 - Registration certificate required.¶
No person shall use any weighing or measuring instrument for commercial purposes without having a current annual registration certificate for the instrument. The certificate shall be in addition to any other certificate, license or permit which may be required by the county or any other government entity.

2.25.040 - Application for registration certificate.¶
An application for the registration certificate must be submitted to the county sealer in the form prescribed by him. The county sealer shall, upon receipt of a completed application and the payment of the applicable fees described in this chapter issue a current registration certificate.

2.25.050 - Terms of registration.¶
Each registration certificate shall expire on December 31st of the year of its initial issuance, or, in the case of a two-year certificate, on the second December 31st following its issuance. The registration certificate may thereafter be renewed on an annual or biennial basis upon payment of the annual fee provided in this chapter. If issued on a biennial basis, the annual fee shall be doubled.

2.25.060 - Annual registration fee.¶
An annual registration fee shall be charged for the calendar year, or any part thereof, for all weighing and measuring instruments requiring a registration certificate as provided for herein. The fees shall be the lessor of (1) actual county cost of performing the inspections and testing, or (2) the current schedule of maximum charges set forth in Business and Professions Code Section 12240.

2.25.070 - Registration certificate—To whom issued.¶
A registration certificate may be issued to a corporation duly authorized to transact business in this state or to any person operating under a fictitious name who has complied with the provisions of Chapter 5 (commencing with Section 17900) of Part 3 of Division 7 of the Business and Professions Code. In all other cases the certificate shall be issued in the true name of the applicant. Otherwise, no business, occupation or activity for which a certificate is required by this chapter may be conducted under any false or fictitious name. A certificate issued to a corporation shall designate the corporation by the exact name which appears in its articles of incorporation.

2.25.080 - Transfer of certificate.¶
A valid registration certificate may be transferred from one person, corporation or business to another, provided the location of the registered weighing or measuring instrument is not substantially changed.

2.25.090 - Delinquent certificate.¶
Any person, corporation or business failing to renew the registration of a weighing or measuring instrument on or before the thirty-first day of the month following its expiration shall, upon renewal, pay as a penalty an additional sum equal to fifty percent of the registration fee.

2.25.100 - Posting certificate.¶
Every registration certificate required pursuant to this chapter shall be conspicuously posted at all times at the location where the weighing or measuring instrument is being used.
