2.12.010 - Office created.

The office of the city manager of the city is created and established. The city manager shall be appointed by the city council on the basis of his executive and administrative qualifications and ability and shall hold office at and during the pleasure of the city council.

2.12.020 - Temporary city manager.

In the case of the absence or disability of the city manager, the city council may designate some qualified person to perform the duties of the city manager during the period of absence or disability of said city manager.

2.12.030 - Compensation.

The city manager shall receive such compensation as the city council shall from time to time determine and fix, and said compensation shall be a proper charge against the general funds of the city.

2.12.040 - Powers and duties.

The city manager shall be the administrative head of the city government under the direction and control of the city council, except as otherwise provided in this chapter. S/he shall be responsible for the efficient administration of all the affairs of the city. In addition to general powers as administrative head, and not as a limitation thereon, the city manager shall have the following powers, to wit:

A. To execute on behalf of the city council its administrative supervision and control of such affairs of the city as may be placed in his charge;

B. To control, order and give directions to all heads of departments, subordinate officers and employees of the city, except elected officers and their respective staffs, and to transfer the employees from one department to another, and to consolidate or combine offices, positions, departments or units under his direction;

C. To appoint and remove any officers and employees of the city, except the elected officers and their respective staffs, subject to ratification by city council in the case of department heads. The manager shall inform as to appointments;

D. To exercise control over all departments of the city government and over all appointive officers and employees thereof, except elected officers and their respective staffs;

E. To attend all meetings of the city council unless excused therefrom by the city council;

F. To recommend to the city council for adoption such measures and ordinances as he deems necessary or expedient;

G. To keep the city council at all times fully advised as to the financial condition and needs of the city;

H. To prepare and submit to the city council the annual budget;

I. To prepare and submit to the city council as of the end of each fiscal year a complete report on the finances and administrative activities of the city for the immediately preceding year, such financial report not to be confused with the city clerk's report to the state controller;

J. To make investigation into the affairs of the city, and any department thereof, and any contract, or the proper performance of any obligation of the city;

K. To investigate all complaints in relation to matters concerning the administration of the city government and in regard to the service maintained by public utilities in the city and to see that all franchises, permits and privileges granted by the city are faithfully performed and observed;

L. To exercise general supervision over all public buildings, public parks and other public property which are under the control and jurisdiction of the city council;

M. To supervise in general the operation of all departments of the city, securing technical counsel or advise as required;

N. In addition to the elected officers and their respective staffs, the position of city attorney, and city auditor shall be excluded from the scope of the city manager's surveillance; however, the services and facilities of this office shall be made available to the city manager;

O. To perform such other duties and exercise such other power as may be delegated to the city manager from time to time by ordinance or resolution of the city council;

P. To analyze the functions, duties and activities of the various departments and services of the city government of the city and of all employees thereof and to make such recommendations to the city council with reference thereto as in his judgment will result in the highest degree of efficiency in the operation of the city government;

Q. To compile and maintain currently a complete inventory of all property, real and personal, owned by the city.

2.12.050 - Scope of power.

The city manager shall act as the agent for the city council in the discharge of its administrative functions, but shall not exercise any policymaking or legislative functions whatsoever nor attempt to commit or bind the city council or any member thereof to any action, plan or program requiring city council action. No authority is granted to nor is any duty imposed upon the city manager by virtue of this chapter which is by general law or valid ordinance vested in or imposed upon any other city commission, department, officer or employee.

2.12.060 - Abolition of commissioners offices.

After the effective date of the ordinance codified in this chapter, the system of city commissioners shall be abolished.

2.12.070 - Administrative office.

There shall be established the administrative office of the city, which shall be administered as a department of the city with the city manager acting as department head thereof.
