5-10.101 - Definitions.¶
For the purposes of this article, unless otherwise apparent from the context, certain words and phrases used in this article are defined as follows:
(a) "Handbill" shall mean any handbill, dodger, commercial advertising circular, folder, booklet, letter, card, pamphlet, sheet, poster, sticker, banner, notice, or other written, printed, or painted matter calculated to attract the attention of the public.
(b) "Person" shall include any person, firm, partnership, association, corporation, company, or organization of any kind.

5-10.102 - Permit required.¶
No person shall engage in the business of posting, printing, sticking, stamping, tacking, or otherwise affixing any handbill to or upon any public or private property unless a permit in writing so to do is first obtained from the Council.
Every such permit shall be numbered consecutively, and upon the handbill to be so posted, printed, stuck, stamped, tacked, or otherwise affixed there shall be printed, painted, or otherwise permanently affixed thereto the words and figures "Permit No. _______", (inserting the number of such permit).
Any such handbill found so posted, printed, stuck, stamped, tacked, or otherwise affixed without the words and figures required by this section being plainly visible thereon shall be prima facie evidence that the same was so displayed contrary to the provisions of this section and may be removed by the Police Department.
No license shall be issued to engage in or carry on any business mentioned in this section until the permit required by this section has been obtained and filed with the City Clerk.

5-10.103 - Distribution to vehicles.¶
No person shall distribute any handbill to passengers on any bus or streetcar or throw, place, or attach any handbill in, to, or upon any automobile or other vehicle.

5-10.104 - Distribution on public property.¶
(a) No person shall, upon any street, sidewalk, or park, cast, throw, deposit, or distribute among pedestrians or to persons in vehicles any commercial advertising handbill or any handbill distributed for the purpose of advertising any merchandise, commodity, property, business, service, art, or skill offered, sold, or rendered for hire, reward, price, trade, or profit.
(b) The provisions of subsection (a) of this section shall not be deemed or construed to prohibit or restrict the distribution of written or printed matter devoted to the expression of views, opinions, beliefs, or contentions relating to religious, political, or sociological subjects, or to public or civic affairs, or to labor disputes or other controversies, or to community, State, regional, national, or international affairs, or which treat of any social or economic order, or which relate to the arts or sciences, or which is aimed to redress any grievance, or which otherwise is not distributed for the purpose of soliciting business, trade, or custom; nor shall the provisions of subsection (a) of this section be deemed to include the printed notice of an event which is not arranged for profit or to stimulate the business, trade, or traffic of the person who causes the dissemination of the notice, even though a monetary contribution or an admission fee shall be requested or accepted in connection with such event.

5-10.105 - Distribution on private property.¶
No person shall distribute, deposit, throw, place, or attach any handbill to, in, or upon any porch, yard, steps, or mailbox located upon any premises not in the possession of or under the control of the person distributing such handbill, which premises has posted thereon in a conspicuous place a sign at least twelve (12) square inches in area bearing the words "No Advertising" unless the person distributing the handbill has first received the written permission of the person occupying or having possession of such premises authorizing the distributor so to do.

5-10.106 - Posting on private property.¶
No person shall paint, mark, or write on or post or otherwise affix or attach any handbill or sign to or upon any building or wall, or part thereof, or upon any private property without the consent of the owner, agent, or occupant thereof.

5-10.107 - Posting on public property.¶
No person shall paint, mark, or write on or post or otherwise affix any handbill or sign to or upon any sidewalk, crosswalk, curb, curbstone, street lamp post, hydrant, tree, shrub, tree stake or guard, railroad trestle, electric light or power or telephone or telegraph or trolley-wire pole, or wire appurtenance thereof, or upon any fixtures of the fire alarm or police telegraph system, or upon any lighting system, public bridge, drinking fountain, street sign, or traffic sign.
The provisions of this section shall not apply to the installation of terrazzo sidewalks or sidewalks of similar construction or sidewalks permanently colored by an admixture in the material of which the same are constructed and for which the City has granted a written permit.

5-10.108 - Identification.¶
No person shall distribute any handbill in any place under any circumstances, which handbill does not have printed on the cover or the face thereof the name and address of the following:
(a) The person who printed, wrote, compiled, or manufactured the same; and
(b) The person who caused the same to be distributed; provided, however, in the case of a fictitious person or club, in addition to such fictitious name, the true names and addresses of the owners, managers, or agents of the person sponsoring such handbill shall also appear thereon.

5-10.109 - Exceptions to provisions.¶
The provisions of this article shall not be deemed to apply to the distribution of the United States mail nor to the delivery of any handbill to any person who has requested delivery of the same.
