5-37.01 - Residential parties: Publicized commercialism prohibited.

(a) Definitions. For the purposes of this chapter, unless otherwise apparent from the context, certain words and phrases used in this chapter are defined as follows:

(1) "Party" shall mean a group of persons meeting together for social, recreational, or amusement purposes, but excluding meetings for political, charitable, or religious purposes.

(2) "Residential area" shall mean all land in the City which is classified in one of the residential zones in the Maywood Zoning Ordinance as well as all land which is utilized for residential purposes, regardless of zone classification. "Residential area" shall not include land devoted exclusively to park and/or playground purposes.

(3) "Publicized" shall mean an open invitation circulated by flyer or handbill or advertised by publication, posting, or distribution in or about public places, including schools, suggesting that there is unlimited or unreserved attendance.

(4) "Commercial" shall mean the suggestion or the request of a monetary charge or a request for a donation, either for admission, or to offset the charges of either the refreshments and/or band.

(b) Unlawful. It shall be unlawful to host, conduct, or permit a publicized commercial party in any residential area in the City.

(c) Violations: Penalties. The violation of this section shall be a misdemeanor punishable by a fine not to exceed Five Hundred and no/100ths ($500.00) Dollars, or by imprisonment for not to exceed six (6) months, or by both such fine and imprisonment.
