2.09.010 City Attorney¶
There is established in the city a city legal department, the head of which shall be the city attorney who shall be the chief legal officer of the city. Said attorney shall be appointed and shall have such duties as set out in Article VI of the City Charter, which shall include:
- The activities of the legal department and the city attorney shall be governed by the city council pursuant to Article VI of the City Charter, subject only to such article.
- The city council may retain special counsel pursuant to City Charter Section 6.03.
- The city attorney shall cooperate with and coordinate the work of the city attorney with that of the city manager, all department heads, and the city clerk, as provided in Section 6.02B5 of the City Charter.

2.09.020 Additional City Attorney Duties¶
The city attorney shall have the additional duties as provided and set out in this section, and shall include the following:
- Duties. The duties of the city attorney shall be established by ordinance, which duties shall include but not be limited to the duties assigned by the City Charter.
- Charter Duties. The city attorney shall be the chief legal officer of the city, whose duties shall include but not be limited to:
- Advising the city council, individual council members, the city manager and his/her assistants and department heads regarding the law relating to city matters, provided, however, that the city attorney shall not be required to advise any of these officials concerning his/her liabilities relating to personal conflicts of interest;
- Representing the city in legal proceedings;
- Preparing or reviewing and approving as to form, all ordinances, contracts and other needed city legal documents;
- Select and retain specialist counsel when there is a need for such specialized legal services, subject to approved of the city council;
- Cooperate with and coordinate the work of the city attorney with that of the city manager, all city department heads, and the city clerk;
- Perform all duties required of a city attorney by state law; and,
- Perform such other duties consistent with this Charter as may be required by the city council by ordinance, resolution, minute order or contract.
