§ 2-3.901. Department heads withdrawn from classified service.

For the purposes of this article, the Council hereby finds and determines that the following are full-time department heads of the City:

(a) Building Official;

(b) City Engineer-Director of Public Works;

(c) Director of Parks and Recreation;

(d) Director of Finance;

(e) Chief of Police;

(f) Director of Field Services;

(g) Director of Community Development;

(h) Assistant Chief Administrative Officer; and

(i) Assistant Chief Administrative Officer/Director of Community Development:

and subject to the provisions set forth in this article, the department heads are withdrawn from the classified service of the City.

§ 2-3.902. Removal.

(a) Removal, demotion, layoff or suspension of Department Heads is the duty of the City Manager. The City Manager shall report all such actions to the City Council. No right to appeal such decision pursuant to Section 1-4.01 shall exist.

(b) Compensation. Upon his or her removal, the Department Head shall be paid a sum equal to two months' salary, but only if he or she does not continue in the employment of the City. This section does not apply to the retirement of a Department Head or to Department Heads with written employment contracts with the City and shall not apply to persons who become Department Heads after the effective date of the ordinance adopting this section.

§ 2-3.903. Removal: Limitations.

Notwithstanding the provisions of Section 2-3.902 of this article, a Department Head shall not be removed from office during, or within a period of 90 days next succeeding, or within 60 days prior to any general or special municipal election held in the City, at which election a member of the Council is elected. After expiration of such 90 day period, the provisions of Section 2-3.902 of this article relating to the removal of Department Heads shall apply and be effective. This section does not apply to persons who become Department Heads after the effective date of the ordinance adopting this section.

§ 2-3.904. Residence of the Police Chief.

The Police Chief shall reside not more than 15 miles from the City limits.
