§ 10.76.010. Requirement of license and display of license.

It is unlawful for any person to operate or use a bicycle, as the same is or may hereinafter be defined in Division 16.7 of the California Vehicle Code, upon any public property within the city without first obtaining a license therefor from the director of licensing and code enforcement or designee, and affixing and displaying at all times said license to the front of the seat tube of the bicycle frame.

§ 10.76.020. Registrar of bicycles designated.

The director of licensing and code enforcement shall be the registrar of bicycles.

§ 10.76.030. Issuance of license.

The registrar of bicycles is authorized and directed to issue bicycle licenses upon written application. Such licenses shall be issued in conformance with all applicable provisions of the California Vehicle Code.

§ 10.76.050. License fee, renewal license fee, replacement license fee and transfer of…

A fee established by resolution duly adopted by the city council of the city of Hawthorne for each license period shall be paid in advance.

The license fee to be paid for each license for each bicycle, for each renewal of a license, replacement of lost licenses or registrations, and for each transfer of ownership registration shall be forwarded to the registrar of bicycles and shall be deposited in the city treasury to be used to offset the cost of this program, to improve bicycle safety programs, and to develop and maintain bicycle facilities.

§ 10.76.060. License fees remitted to registrar.

All bicycle license fees and bicycle renewal fees and all registration and renewal documents shall be remitted to the registrar of bicycles no later than ten business days after the close of each calendar month. A designated agent may elect to prepay the license fees by remitting to the registrar of bicycles the amount due for all licenses received by the designated agent at the time of his or her receipt of the licenses.

§ 10.76.070. Licenses and registration certificates.

The registrar of bicycles shall provide such licenses and registration certificates to the designated agents as shall hereinafter be provided by the state, in conformance with all applicable provisions of the California Vehicle Code. Registration certificates shall include such information as may hereinafter be required by the California Vehicle Code and the registrar of bicycles. The registrar of bicycles shall compile and maintain records of each bicycle registered.

§ 10.76.080. Expiration and renewal of licenses.

Expiration and renewal periods shall be as provided in Division 16.7 of the California Vehicle Code.

§ 10.76.090. Denial of a license.

No license shall be issued or renewed for any bicycle which does not conform to all applicable provisions of the California Vehicle Code.

§ 10.76.100. Removing bicycle licenses prohibited.

A. It is unlawful for any person to:

  1. Willfully or maliciously remove, destroy, mutilate or alter the number of any bicycle frame licensed pursuant to this chapter;

  2. Willfully remove, destroy, mutilate or alter any license or registration certificate during the time in which such license or registration certificate is operative or valid.

B. Nothing in this section shall prohibit the registrar of bicycles from stamping identification numbers on the frames of bicycles on which no serial number can be found, or on which said number is illegible or insufficient for identification purposes.

§ 10.76.110. Conflict with Vehicle Code.

Should any provisions of the California Vehicle Code conflict with any provisions of this chapter, such provisions of the Vehicle Code shall have precedence.

§ 10.76.120. Violation—Fine established.

Any designated agent and/or any bicycle owner or operator who willfully fails or refuses to fulfill the requirements of this chapter shall be subject to a fine for each such instance of violation.
