Sec. 27-11. - Definitions.

For the purposes of this article, the following words and phrases shall have, unless otherwise expressly stated, the meanings respectively ascribed to them by this section:

Bus. Any motor vehicle, other than a motortruck or truck tractor, designed for carrying more than ten (10) persons including the driver, and used or maintained for the transportation of passengers, except that any motor vehicle, other than a motortruck or truck tractor designed for carrying not more than twelve (12) persons, including the driver, which is maintained and used in the nonprofit transportation of adults to and from a work location as part of a carpool program or when transporting only members of the household of the owner thereof, shall not be considered to be a bus for the purposes of this section.

Motor coach. Any motor vehicle used or maintained for the transportation of passengers which is not a bus as defined in this section or a taxicab as defined in section 27-59.

Sec. 27-12. - Liability insurance required.

(a) It shall be unlawful for an owner or operator of a bus or motor coach to drive or operate the same, or cause the same to be driven or operated in the city, and no license for the operation thereof shall be granted, unless there is on file with the city clerk, and in force and effect at all times while any such bus or motor coach is being operated, a policy of insurance approved by the city attorney with a solvent and responsible insurance company authorized to do business in the state, insuring the owner of such bus or motor coach against loss by reason of injury, death or damage that may result to person or property from the negligent operation, maintenance, control or defective construction of such bus or motor coach, or for any other cause.

(b) Such policy or policies of liability insurance shall be in such amounts as may be required by resolution by the city council from time to time; or, if there be no such resolution, then in the amounts carried by the city.

Sec. 27-13. - Establishment of charges in lieu of business license tax.

The city council shall have the right to establish a charge against any person or persons operating a bus line or motor coach line in the city based upon a percentage of the gross revenue of such business operation. Such charge shall be established by resolution of the city council and can be changed on or before July first of each year, or at such times as the city council may deem proper by resolution. Such charge shall be in lieu of any business license tax which may be required by any laws of the city.

Sec. 27-14. - Right of council to adopt.

The city council shall have the right from time to time to adopt by resolution such other requirements as it may deem proper regarding the operation of buses or motor coaches within the city which are not inconsistent with this article.

Sec. 27-15. - Establishment of routes and stops.

The city council may from time to time by resolution establish such routes for buses or motor coaches within the city and establish such bus or motor coach stops as it may deem necessary and proper.

Sec. 27-16. - Duty of driver to adhere to established routes and stops; exception.

Whenever the city council has established routes and stops within the city pursuant to section 27-15, it shall be unlawful for the driver of any bus or motor coach, when the vehicle is in service, to deviate from the established routes and to stop at places other than the established stops, except when directed to deviate from such route or to stop at another location by a police officer of the city.
