11.12.010 - Park restriction—Signs.

No person shall park any vehicle, whether attended or unattended, upon Duarte Park or any portion thereof, except upon such portions thereof as may be marked with signs stating that parking is permitted thereon. Signs permitting parking shall be placed by the city administrator upon all parking lots and upon such other areas in Duarte Park where parking will not unduly interfere with park and recreation uses. Such signs may be permanent or temporary in nature and parking areas may be changed from time to time by the city administrator as necessary to allow the maximum park and recreation benefits to be obtained from Duarte Park.

11.12.020 - Sign procurement and placement.

The city administrator is directed to procure and place in Duarte Park such signs as may be reasonably necessary to notify persons of the areas where parking is and is not permitted.

11.12.021 - Parking on city property.

Whenever the city manager determines that the orderly and efficient conduct of the city's business requires that parking or standing of vehicles on real property being a part of or serving municipal buildings or facilities shall be prohibited, limited or restricted, then the city manager shall have the power and authority to order signs to be erected or posted indicating that the parking of vehicles on such real property is prohibited, limited or restricted.

When signs authorized by the provisions of this section are in place or notice thereof, no person shall park or stand any vehicle contrary to the directions or provisions of such signs.

11.12.022 - Regulations—Public parking lots.

(a) The driveways, passageways and circulation routes within a public parking area, serving a "shopping center," as defined in Title 19, whether publicly or privately owned, are designated as traffic and fire access lanes.

(b) When appropriate signs are posted thereon, no person shall stand or park a vehicle within any such traffic or fire access lane, and all provisions of the vehicle code may be enforced with regard thereto.

11.12.024 - Parking of vehicles for sale or repair, etc.

No person shall park a vehicle upon a parking lot or area in any commercial zone:

(a) For the purpose of displaying the vehicle for sale; or

(b) For the purpose of repairing, washing, waxing, greasing or otherwise working upon the vehicle in any manner.

The prohibitions of this section shall not apply to vehicles which are parked by, or with the permission of, an occupant of real property who possesses a valid business license from the city to carry on a commercial activity upon such real property, which activity includes the conduct otherwise prohibited by this section.

11.12.030 - Width and weight restrictions.

(a) No person shall park or leave standing any commercial vehicle having a maximum width in excess of eighty inches or weighing in excess of ten thousand pounds upon any street, unimproved parkway, other unimproved property dedicated to public use, or portion thereof for a period of time exceeding two hours, except when necessary for the purpose of making pickups and deliveries of goods, wares and merchandise from or to any building or structure fronting upon any street, or for the delivery of building materials to a building site fronting on any street, only while loading or unloading operations are in progress.

(b) Any vehicle found in violation of this section may be cited and/or removed from the public street. If removed, said vehicle shall be stored until such time as it is claimed by the registered owner. The cost of removal and storage shall be borne by the registered owner.

(c) The provisions of this section shall not apply to (1) passenger buses under the jurisdiction of either the California Public Utilities Commission or federal regulatory authority, or to (2) any vehicle owned by a public utility while necessarily in use in the construction, installation or repair of any public utility.

(d) PENALTY. Notwithstanding the provisions of Section 11.12.070, violation of this section shall be punishable as an infraction with a fine not to exceed two hundred fifty dollars.

(e) The street superintendent shall erect signs giving reasonable notice of the parking restrictions set forth in this section.

11.12.031 - Weight restriction.

No person shall stop, stand or park a vehicle which exceeds ten thousand pounds in weight, including its load, on any street for a period of time longer than two hours. This section does not apply to public emergency vehicles and disabled vehicles as defined in Section 11.12.060.

11.12.040 - Handicapped parking.

No person shall park or leave standing any vehicle in a stall or space designated for physically handicapped persons if, immediately adjacent to and visible from such stall or space, there is posted a sign identifying the stall or space as a handicapped parking area, unless the vehicle displays one of the distinguishing license plates or a placard issued pursuant to Section 22511.5 of the California Vehicle Code, or issued to disabled veterans as specified in California Vehicle Code Section 9105. Violation of this section shall be punishable as specified in California Vehicle Code Section 42001.13.

11.12.041 - Failure to properly display disabled person's parking placard or plates—Administrative fee.

Any motorist who, when utilizing a parking space designated for handicapped parking, fails to display on the vehicle, in a manner visible from the exterior of the vehicle, a lawfully issued handicapped placard, permit, or plate, thereby causing the issuance of a parking citation for unlawful handicapped parking, which citation is later dismissed for any reason, shall pay to the city an administrative fee established by resolution of the city council.

11.12.050 - Stopping on roadway prohibited—Exception.

Upon any street or highway in the city no person shall stop, park or leave standing any vehicle, whether attended or unattended, when it is practicable to stop, park, or leave the vehicle off such portion of the street or highway; but in every event an unobstructed width of the street or highway opposite a standing vehicle shall be left for the free passage of other vehicles and a clear view of the stopped vehicle shall be available from a distance of two hundred feet in each direction upon the street or highway. This section shall not apply upon a street or highway where the roadway is bounded by adjacent curbs.

11.12.060 - Exception for disabled vehicle.

Section 11.12.050 shall not apply to the driver of any vehicle which is disabled in such a manner and to such extent that it is impossible to avoid stopping and temporarily leaving the disabled vehicle on the roadway.

11.12.061 - Effect upon state highways.

Any provision of this chapter which regulates traffic or delegates the regulation of traffic upon state highways in any way for which the approval of the Department of Public Works is required by state law, shall cease to be operative six months after receipt by the city council of written notice of withdrawal of approval of the Department of Public Works.

11.12.070 - Penalty for violation.

Any person who violates any provision of this chapter is guilty of a misdemeanor punishable as provided in Section 1.04.100 of this code.
