31-36 PROCEDURE.

31-36.1 Maps.

a. Filing . After a profiling conference with the Planning Department and the Engineering Department, twelve (12) copies of maps providing for reversion to acreage shall be filed with the Planning Department and shall be in the form of a final map or parcel map, dependent upon which was used to file the original subdivision.

b. Street and Easement Designation . Such a map shall delineate any streets or easements to be left in effect after the reversion to acreage.

  • c. Bond, Fee Required . Any map so submitted shall be accompanied by:
  1. A guarantee of title in the amount of one thousand ($1,000.00) dollars for the benefit of the Town, issued by a recognized title insurance company;

  2. Evidence of nonuse of streets or easements; and

  3. A filing fee as established or adopted by the Town Council by resolution, no part of which shall be refundable.

d. Hearing . The Planning Department shall conduct its hearing in accordance with requirements of California Government Code Sections 66499.11 through 66499.20-1/2.

e. Planning Commission Action . The Planning Commission shall act upon the map within forty (40) calendar days after its next regular meeting, or such other time as mutually agreed upon by the subdivider and Planning Commission or the map shall be deemed disapproved unless the Planning Commission expressly continues the matter.

f. Certification . The map shall be certified by the County Surveyor as required by the Subdivision Map Act. The provisions and fee for map checking as set forth in subsection 31-11.24 shall be applicable to checking reversion to acreage maps prior to certification.

g. Filing for Resubdivision . A tentative map for resubdivision may be filed concurrently with the aforesaid reversion map.
