10.36.010 Applicability of regulations.¶
A. The provisions of this chapter prohibiting the stopping, standing or parking of a vehicle shall apply at all times or at those times herein specified, except when it is necessary to stop a vehicle to avoid conflict with other traffic, or in compliance with the directions of a police officer or official traffic-control device.
B. The provisions of this chapter imposing a time limit on standing or parking shall not relieve any person from the duty to observe other and more restrictive provisions of the Vehicle Code of the State or the ordinances of this City prohibiting or limiting the standing or parking of vehicles in specified places or at specified times. 10.36.020 No-stopping and no-parking zones—Authorized when—Driver obedience required.¶
The City Manager is hereby authorized to maintain, by appropriate signs or by paint upon the curb surface, all nostopping zones, no-parking areas, and restricted parking areas, as defined and described in this Title. When such curb markings or signs are in place, no operator of any vehicle shall stop, stand or park such vehicle adjacent to any such legible curb marking or sign in violation of any of the provisions of this chapter. 10.36.030 No-stopping zones.¶
A. The City Manager shall designate established no-stopping zones by placing and maintaining appropriate signs indicating that stopping of vehicles is prohibited and indicating the hours and days when stopping is prohibited.
B. During the hours and on the days designated on the signs, it is unlawful for the operator of any vehicle to stop such vehicle on any of the streets or parts of streets established by ,resolution of the City Council as nostopping zones. 10.36.040 Narrow streets—Parking prohibited when.¶
A. The City Manager is authorized to place signs or markings indicating no parking upon any street unless a minimum of ten feet of paved way is left clear and unobstructed for the free passage of other vehicles.
B. When official signs or markings prohibiting parking are erected upon narrow streets as authorized herein, no person shall park a vehicle upon any such street in violation of any such sign or marking. (Ord. 87-4 § 29, 1987; Ord. 76-3 § 1, 1976; Ord. 155 NS § 10.8, 1967; prior code § 13-51.)
10.36.050 Parking on grades.¶
No person shall park or leave standing any vehicle unattended on any street when upon any grade exceeding three percent without blocking the wheels of such vehicle by turning them against the curb or by other means. (Ord. 155 NS § 10.9, 1967; prior code § 13-52.)
10.36.060 Parking space markings.¶
A. The City Manager is authorized to install and maintain parking space markings to indicate where authorized parking is permitted and shall erect signs giving notice thereof. When such parking space markings are placed on the streets, no vehicle shall be stopped, left standing or parked other than within the space markings.
B. On streets where space markings have been installed to indicate parking spaces parallel to curbings, a property owner may park in front of his private driveway, carport, or garage only under either of the following conditions:
There is a designated parking space marking on the street immediately adjacent to the property owner’s driveway, carport, or garage. Parking is not permitted unless a minimum of ten feet of paved way is left clear and unobstructed for the free passage of other vehicles. The amount of paved way shall be measured from the outboard of the parked car to the opposite edge of the paved roadway; if there is a parking space marking on the opposite side of the roadway, the amount of paved way shall be measured from the outboard of the car to the parking space marking; or
The vehicle is parked off the paved public right of-way upon the property owner’s driveway and no part of the vehicle extends into the roadway. (Ord. 89-5 § 1, 1989; Ord. 87-4 § 30, 1987; Ord. 76-3 § 1, 1976; Ord. 155 NS § 11.5, 1967; prior code § 13-61.)
10.36.070 Parallel parking procedures—Exceptions.¶
A. Subject to other and more restrictive limitations, a vehicle may be stopped or parked within eighteen inches of the curb unless signs are in place prohibiting such stopping or standing.
B. In the event a street includes two or more separate roadways and traffic is restricted to one direction upon any such roadway, no person shall stand or park a vehicle upon the left-hand side of such one-way roadway unless signs are in place permitting such standing or parking.
C. The City Manager is authorized to determine when standing or parking shall be prohibited upon any street, or when standing or parking may be permitted upon the left-hand side of any one-way roadway of a street having two or more separate roadways, and shall erect signs giving notice thereof.
D. The requirements of parallel parking imposed by this Section shall not apply in the event any commercial vehicle is actually engaged in the process of loading or unloading freight or goods, in which case such vehicle may be backed up to the curb; provided, that such vehicle shall not extend beyond the centerline of the street and shall not block traffic thereby. 10.36.080 Diagonal parking restrictions—Exceptions.¶
A. On any of the street or portions of streets established by resolution of the City Council as diagonal parking zones, when signs or pavement markings are in place indicating such diagonal parking, it is unlawful for the operator of any vehicle to park such vehicle except:
At the angle to the curb indicated by signs or pavement markings allotting space to parked vehicles and entirely within the limits of such allotted space;
With the front wheel nearest the curb within six inches of such curb.
B. The provisions of this Section shall not apply when such vehicle is actually engaged in the process of loading or unloading passengers, freight or goods, in which event the provisions applicable in Section 10.36.070 shall be complied with. 10.36.100 Emergency parking—Signs required—Effect.¶
A. Whenever the City Manager or Chief of Police determines that an emergency traffic congestion is likely to result from the holding of public or private assemblages, gatherings or functions, or for other reasons, the City Manager or Chief of Police shall have power and authority to order temporary signs to be erected or posted indicating that the operation, parking or standing of vehicles is prohibited on such streets and alleys as the City Manager or Chief of Police shall direct during the time such temporary signs are in place. Such signs shall remain in place only during the existence of such emergency, and the City Manager or Chief of Police shall cause such signs to be removed promptly thereafter
B. When signs authorized by the provisions of this Section are in place giving notice thereof, no person shall operate, park or stand any vehicle contrary to the directions and provisions of such signs. (Ord. 87-4 § 33, 1987; Ord. 76-3 § 1, 1976; Ord. 155 NS § 10.11, 1967; prior code § 13-54.)
10.36.110 No-stopping and no-parking zones—Curb markings described—Compliance required.¶
A. The City Manager is authorized, subject to the provisions and limitations of this chapter, to place, and when required herein shall place, the following curb markings to indicate parking or standing regulations, and such curb markings shall have the meanings as set forth in this Section.
Red shall mean no stopping, standing or parking at any time, except as permitted by the Vehicle Code of the State, except that a bus may stop in a red zone or signed as a bus zone.
Yellow shall mean no stopping, standing or parking at any time during designated times as determined by the City Manager for any purpose other than the loading or unloading of passengers or materials; provided, that the loading or unloading of passengers shall not consume more than three minutes nor the loading or unloading of materials more than twenty minutes.
White shall mean no stopping, standing or parking for any purposes other than loading or unloading of passengers, or for the purpose of depositing mail in an adjacent mailbox, which shall not exceed three minutes; such restrictions shall apply between seven a.m. and six p.m. of any day except Sundays and holidays, except that when such zone is in front of a mailbox, the restrictions shall apply at all times.
B. When the City Manager, as authorized under this Title, has caused curb markings to be placed, no person shall stop, stand or park a vehicle adjacent to any such legible curb marking in violation of any of the provisions of this Section. 10.36.120 Stopping, standing or parking—Locations where prohibited.¶
No operator of any vehicle shall stop, stand, park or leave standing any vehicle in any of the following places, except when necessary to avoid conflict with other traffic, or in compliance with the direction of a police officer or other authorized officer, traffic sign or signal.
- A. Within any divisional island, unless authorized and clearly indicated with appropriate signs or markings;
B. On either side of any street between the projected property lines of any public walk, public steps, street or thoroughfare terminating at such street, when such area is indicated by appropriate signs or by red paint upon the curb surface;
C. In any area where the City Manager determines that the parking or stopping of a vehicle would constitute a traffic hazard or would endanger life or property, when such area is indicated by appropriate signs or by red paint upon the curb surface;
- D. In any area established by resolution of the City Council as a no-parking zone;
E. In any area where the parking or stopping of any vehicle would constitute a traffic hazard or would endanger life or property;
F. On any street where the use of such street or a portion thereof is necessary for the cleaning, repair or construction of the street or the installation of underground utilities, or where the use of the street or any portion thereof is authorized for a purpose other than the normal flow of traffic or where the use of the street or any portion thereof is necessary for the movement of equipment, articles or structures of unusual size, and the parking of such vehicle would prohibit or interfere with such use or movement; provided, that signs giving notice of such no-parking shall be erected or placed at least twenty-four hours prior to the effective time of such noparking;
G. At any place within twenty feet of a crosswalk at an intersection when such place is indicated by appropriate signs or by red paint upon the curb surface except that a bus may stop at a designated bus stop;
H. Within twenty feet of the approach to any boulevard stop sign. (Ord. 87-4 § 35, 1987; Ord. 76-3 § 1,1976, 1976; Ord. 155 NS § 10.2, 1967; prior code § 13-45.)
10.36.130 Parked or unattended vehicles prohibited.¶
Whenever any peace officer finds a vehicle unattended upon any bridge or causeway, or where such vehicle constitutes an obstruction to traffic, or upon a street, lane or road illegally parked so as to block the entrance to a private driveway, such officer may provide for the removal of such vehicle to the nearest garage or other place of safety. (Ord. 18 NS § 4, 1938.)
10.36.150 Electric vehicle charging station parking stalls.¶
A. It shall be unlawful to park in a designated electric vehicle charging station parking stall unless the vehicle is a charging electric vehicle.
B. It shall be unlawful to obstruct, block, or otherwise bar access to parking stalls or spaces described in Subsection A of this Section, except as provided in Subsection A.
C. No operator of any vehicle shall park in a designated electric vehicle charging station parking stall for a period of time longer than four hours between the hours of eight a.m. and six p.m. any day.
D. The City Council may, by resolution, specify the fees which the City shall charge members of the public for each electric vehicle charging session. (Ord. 2013-1 § 4, 2013.)
10.36.160 Two-hour parking.¶
When authorized signs or curb markings have been determined by City Manager to be necessary and are in place giving notice thereof, no operator of any vehicle shall stop, stand or park such vehicle between the hours of nine a.m. and six p.m. of any day, for a period of time longer than two hours unless otherwise provided for by this Code. (Ord. 85-3 § 3, 1985; Ord. 76-3 § 1, 1976; Ord. 155 NS § 11.2, 1967; prior code § 13-58.)
10.36.165 Two-hour restricted parking zones along Cove Road, Peninsula Road, Lagoon…¶
A. It is unlawful for any person or the owner, operator or person in charge of any motor vehicle to stop, park or leave standing or to cause or to permit to be parked, stopped or left standing any motor vehicle for a greater period or length of time than two hours between the hours of eight a.m. and six p.m. during any day upon or along any of the following streets or portions thereof.
Cove Road on both sides of the street from Beach Road to Lagoon Road;
Peninsula Road on both sides of the street from Beach Road to the end of Peninsula Road; provided, however, that for the purposes of limited implementation, the initial zone shall consist of both sides of the street from Beach Road to 21/26 Peninsula Road. The remaining portion of the street may be included in the enforcement zone by resolution of the City Council;
Lagoon Road on the southwest side of the street from Cove Road to San Rafael Avenue;
Beach Road on both sides of the street from Main Street to 98 Beach Road;
Cove Road Place on both sides of the street from Cove Road to Cove Alley;
The City-owned five-vehicle parking area opposite 74 Bellevue on the southern end of Corinthian Island.
B. Exceptions to the above parking restrictions shall apply to the owner of any motor vehicle which has been issued and displays a current permit pursuant to conditions established by the City Manager allowing preferential parking in the aforementioned zones.
C. The City Manager shall cause signs to be erected and maintained indicating by legible letter, words and figures the hours prescribed for the parking limitations.
- D. The City Manager shall also cause to be developed the necessary administrative procedures and forms to implement the above-mentioned preferential parking program.
E. The provisions of this Section shall not be enforceable against an alleged violator if at the time and place of the alleged violation the sign required by this Section was not in position and sufficiently legible as to be seen. 10.36.167 Overweight vehicle parking restriction.¶
No person shall park and leave standing on Lagoon Road, Maybridge Road or within the Lagoon Road parking lot any vehicle having a gross weight rating of three tons or more, except
- A. While actively loading or unloading persons and/or material.
B. When such vehicle is parked in connection with, or in aid of, the performance of a service to or on a property in the block in which such vehicle is parked, not to exceed seventy-two consecutive hours.
C. When performing repairs of an emergency nature on the vehicle itself, not to exceed twelve consecutive hours.
- D. When such vehicle is involved in a public works project. (Ord. 2006-12 § 3, 2006.)
10.36.168 Overnight parking restriction.¶
No vehicles shall park within the Lagoon Road parking lot between the hours of ten p.m. and six a.m. (Ord. 2006-12 § 4. 2006, 2006.)
10.36.170 One-hour parking.¶
When authorized signs or curb markings have been determined by the City Manager-Police Administrator to be necessary and are in place giving notice thereof, no operator of any vehicle shall stop, stand or park such vehicle between the hours of nine a.m. and six p.m. of any day, except Sundays and holidays, for a period of time longer than one hour. (Ord. 76-3 § 1, 1976; Ord. 155 NS § 11.1, 1967; prior code § 13-57.)
10.36.190 Green curb marking.¶
A. A green curb marking shall mean no standing or parking for a period of time longer than established by the City Council or City Manager.
B. When authorized signs or curb markings have been determined by the City Manager to be necessary and are in place giving notice thereof, no operator of any vehicle shall stop, stand or park such vehicle adjacent to any such legible curb marking or sign in violation thereof. 10.36.200 Parking longer than seventy-two hours prohibited.¶
A. No person who owns or has possession, custody, or control of any vehicle shall park such vehicle upon any public street for more than a consecutive period of seventy-two hours unless allowed under a temporary residential parking permit pursuant to this section. For purposes of this section, a vehicle must be moved at least three hundred feet every seventy-two hours, and not returned to the same location sooner than twelve hours from departure or it shall be considered parked for that period of time. Section 10.48.010 provides for enforcement of violations of this section.
B. A Belvedere resident may seek an exception to this rule for up to six weeks per calendar year per household address. To seek an exception, a resident may apply to the Belvedere Police Department for a temporary residential parking permit that allows vehicles owned or controlled by the resident to be parked on a public street in excess of seventy-two hours for specified dates, not to exceed a cumulative total of six weeks per calendar year per household address. Unless an emergency applies, requests for a temporary residential parking permit shall be submitted to the Belvedere Police Department in advance and only for the duration required. In cases of emergency, requests for a temporary residential parking permit shall be submitted to the Belvedere Police Department within a reasonable time following the emergency. 10.36.210 Parking to display vehicle for sale prohibited—Exception.¶
No operator of any vehicle shall park such vehicle upon any street in this City for the principle purpose of advertising or displaying it for sale, unless authorized by resolution of the City Council. (Ord. 155 NS § 10.4, 1967; prior code § 13-47.)
10.36.220 Washing or polishing vehicles on public ways prohibited when.¶
No person shall wash or cause to be washed, polish or cause to be polished any vehicle or any part thereof upon any public street in this City, when a charge if made for such service. (Ord. 155 NS § 10.6, 1967; prior code § 13-49.)
10.36.230 Repairing or greasing vehicles on public ways prohibited when.¶
No person shall construct or cause to be constructed, repair or cause to be repaired, grease or cause to be greased, dismantle or cause to be dismantled any vehicle or any part thereof upon any public street in this City. Temporary emergency repairs may be made upon a public street. (Ord. 155 NS § 10.5, 1967; prior code § 13-48.)
10.36.240 Driving or parking in certain lanes or alleys prohibited.¶
It is unlawful to drive or park a motor vehicle on any or all lanes or alleys situated and lying within the City limits or which may hereafter be acquired by, or deeded to the City, and they are hereby dedicated to the exclusive use of pedestrians. (Ord. 21 NS § 1, 1938.)

Any person violating any of the provisions of this chapter shall be, for every such offense, guilty of an infraction (Ord. 2013-2 § 18, 2013.)
