Exceptions & special cases

Common mistakes

    SECTION R108—FEES

    R108.1 Payment of fees. A permit shall not be valid until the fees prescribed by law have been paid, nor shall an amendment to a permit be released until the additional fee, if any, has been paid.

    R108.2 Schedule of permit fees. On buildings, structures, electrical, gas, mechanical and plumbing systems or alterations requiring a permit, a fee for each permit shall be paid as required, in accordance with the schedule as established by the applicable governing authority.

    R108.3 Building permit valuations. Building permit valuation shall include total value of the work for which a permit is being issued, such as electrical, gas, mechanical, plumbing equipment and other permanent systems, including materials and labor.

    R108.4 Related fees. The payment of the fee for the construction, alteration, removal or demolition for work done in connection to or concurrently with the work authorized by a building permit shall not relieve the applicant or holder of the permit from the payment of other fees that are prescribed by law.

    3103.1.1 Extended period of service time. Public-occupancy temporary structures shall be permitted to remain in service for 180 days or more without complying with requirements in this code for new building or structures where extensions for up to 1 year are granted by the Building Official in accordance with Section 108.1 and where the following conditions are satisfied:

    1. Additional inspections as determined by the building official shall be performed by a qualified person to verify that site conditions and the approved installation comply with the conditions of approval at the time of final inspection.
    2. A qualified person shall perform follow-up inspections after initial occupancy at intervals not exceeding 180 days to verify the site conditions and the installation conform to the approved site conditions and installation requirements. Inspection records shall be kept and shall be made available for verification by the building official.
    3. An examination shall be performed by a registered design professional to determine the adequacy of the temporary structure to resist the structural loads required in Section 3103.6.
    4. Relocation of the public-occupancy temporary structure shall require a new permit application.

    SPECIAL CONSTRUCTION

    1. A request for an extension is submitted to the building official. The request shall include records of the inspections and examination in Items 1 and 3.

    3103.1.2 Conformance. Temporary structures and uses shall conform to the structural strength, fire safety, means of egress, accessibility, light, ventilation and sanitary requirements of this code as necessary to ensure public health, safety and general welfare.

    3103.2 Construction documents. A permit application and construction documents shall be submitted for each installation of a temporary structure. The construction documents, shall include a site plan indicating the location of the temporary structure and information delineating the means of egress and the occupant load.

    3103.3 Location. Temporary structures shall be located in accordance with the requirements of Table 705.5 based on the fire-resistance rating of the exterior walls for the proposed type of construction.

    3103.4 Means of egress. Temporary structures shall conform to the means of egress requirements of Chapter 10 and shall have an exit access travel distance of 100 feet (30 480 mm) or less.

    3103.5 Bleachers. Temporary bleachers, grandstands and folding and telescopic seating that are not building elements shall comply with ICC 300.

    EMERGENCY. Any event declared by local, state or federal entities that temporarily overwhelms response capabilities and that requires the temporary suspension or modification of regulations, codes or standards to facilitate response to such an event.

    TEMPORARY USE . An activity or practice that is established at a designated location for a period of less than 180 days. Uses include, but are not limited to, those functional designations listed within the occupancy group descriptions in Section 302.1 of the California Building Code .

    SECTION E103—SUBMITTAL DOCUMENTS

    E104.2 Changes over time. As an emergency evolves, submittal documents shall be submitted to demonstrate that the temporary uses of the existing buildings are in compliance with the requirements of this code.

    SECTION E105—PERMITS

    E105.1 Emergency permits. In an emergency situation, where an existing building undergoes a temporary change of use or occupancy, the permit application shall be submitted as soon as practicable to the code official.

    SECTION E106—GENERAL STANDARDS FOR EMERGENCY USES

    E106.1 Scope. The provisions of Sections E106.2 through E106.7 shall apply to all existing structures being repurposed and to all structures relocated to support the response to an emergency.

    E106.2 Intent. The intent of this section is to provide a reasonable level of safety in a structure repurposed for emergency use.

    E106.3 Change of use or occupancy. Existing buildings used in a way that was not originally intended by occupancy class or use shall be allowed without formally changing the occupancy. The previous occupancy and use shall resume upon the conclusion of the emergency . Where the temporary live load of the floor is more than that required by Section 1607 of the California Building Code for the original use, the area designated for the temporary live load shall be posted with placards for the approved live load.

    E106.4 Fire safety provisions. Determination of the fire safety requirements by the code official shall be in accordance with Section E106.4.1 through E106.4.5 in order to make determinations of safe conditions rather than strict adherence to the provisions of the California Fire Code .

    (d) Certificates of Flame Resistance or other documentation affirming the requirements of California Code of Regulations, Title 19, Division 1, Section 315, subsection (a) shall be made available upon request of the enforcement authority.

    SECTION 3105—TEMPORARY SPECIAL EVENT STRUCTURES

    3105.1 General. Temporary special event structures shall comply with Section 3104, Sections 3105.2 through 3105.8 and ANSI E1.21.

    3105.2 Approval. Temporary special event structures required to have a permit, as set forth in Sections 105.5 and 105.6, shall not be erected, operated or maintained for any purpose without first obtaining approval and a permit from the fire code official and the building official.

    3105.3 Use period. Temporary special event structures erected in accordance with ANSI E1.21 shall not be erected for a period of more than six consecutive weeks.

    3105.4 Required documents. The following documents shall be submitted to the fire code official and the building official for review before a permit is approved:

    1. Construction documents: Construction documents shall be prepared by a registered design professional in accordance with the California Building Code and ANSI E1.21 where applicable. Construction documents shall include: 1.1. A summary sheet showing the building code used, design criteria, loads and support reactions. 1.2. Detailed construction and installation drawings. 1.3. Design calculations. 1.4. Operating limits of the structure explicitly outlined by the registered design professional including environmental conditions and physical forces. 1.5. Effects of additive elements such as video walls, supported scenery, audio equipment, vertical and horizontal coverings. 1.6. Means for adequate stability including specific requirements for guying and cross-bracing, ground anchors or ballast for different ground conditions.
    2. Designation of responsible party: The owner of the temporary special event structure shall designate in writing a person to have responsibility for the temporary special event structure on the site. The designated person shall have sufficient knowledge of the construction documents, manufacturer’s recommendations and operations plan to make judgments regarding the structure’s safety and to coordinate with the fire code official.
    3. Operations plan: The operations plan shall reflect manufacturer’s operational guidelines, procedures for environmental monitoring and actions to be taken under specified conditions consistent with the construction documents.

    3105.5 Inspections. Inspections shall comply with Section 109 and Sections 3105.5.1 and 3105.5.2.

    3105.5.1 Independent inspector. The owner of a temporary special event structure shall employ a qualified, independent approved agency or individual to inspect the installation of a temporary special event structure.

    3105.5.2 Inspection report. The inspecting agency or individual shall furnish an inspection report to the fire code official. The inspection report shall indicate that the temporary special event structure was inspected and was or was not installed in accordance with the approved construction documents. Discrepancies shall be brought to the immediate attention of the installer for correction. Where any discrepancy is not corrected, it shall be brought to the attention of the fire code official and the designated responsible party.

    3105.6 Means of egress. The means of egress for temporary special event structures shall comply with Chapter 10.

    3105.7 Location. Temporary special event structure shall be located a distance from property lines and buildings to accommodate distances indicated in the construction drawings for guy wires, cross-bracing, ground anchors or ballast. Location shall not interfere with egress from a building or encroach on fire apparatus access roads.

    G112.6 Decks, porches, and patios. Decks, porches and patios shall be designed and constructed in accordance with ASCE 24.

    G112.7 Nonstructural concrete slabs in coastal high-hazard areas and coastal A zones. In coastal high-hazard areas and coastal A zones, nonstructural concrete slabs used as parking pads, enclosure floors, landings, decks, walkways, patios and similar nonstructural uses are permitted beneath or adjacent to buildings and structures provided that the concrete slabs shall be constructed in accordance with ASCE 24.

    G112.8 Roads and watercourse crossings in regulated floodways. Roads and watercourse crossings that encroach into regulated floodways, including roads, bridges, culverts, low-water crossings and similar means for vehicles or pedestrians to travel from one side of a watercourse to the other, shall meet the requirement of Section G104.5.

    SECTION G113—TEMPORARY STRUCTURES AND TEMPORARY STORAGE

    G113.1 Temporary structures. Temporary structures shall be erected for a period of less than 180 days. Temporary structures shall be anchored to prevent flotation, collapse or lateral movement resulting from hydrostatic loads, including the effects of buoyancy, during conditions of the design flood. Fully enclosed temporary structures shall have flood openings that are in accordance with ASCE 24 to allow for the automatic entry and exit of floodwaters.

    G113.2 Temporary storage. Temporary storage includes storage of goods and materials for a period of less than 180 days. Stored materials shall not include hazardous materials.

    G113.3 Floodway encroachment. Temporary structures and temporary storage in floodways shall meet the requirements of G104.5.

    SECTION G114—UTILITY AND MISCELLANEOUS GROUP U

    G114.1 Utility and miscellaneous Group U. Utility and miscellaneous Group U includes buildings that are accessory in character and miscellaneous structures not classified in any specific occupancy in this code, including, but not limited to, agricultural buildings, aircraft hangars (accessory to a one- or two-family residence), barns, carports, fences more than 6 feet (1829 mm) high, grain silos (accessory to a residential occupancy), greenhouses, livestock shelters, private garages, retaining walls, sheds, stables and towers.

    G114.2 Flood loads. Utility and miscellaneous Group U buildings and structures, including substantial improvement of such buildings and structures, shall be anchored to prevent flotation, collapse or lateral movement resulting from flood loads, including the effects of buoyancy, during conditions of the design flood.

    G114.3 Elevation. Utility and miscellaneous Group U buildings and structures, including substantial improvement of such buildings and structures, shall be elevated such that the lowest floor, including basement, is elevated to or above the design flood elevation in accordance with Section 1612 of this code.

    G114.4 Enclosures below design flood elevation. Fully enclosed areas below the design flood elevation shall be constructed in accordance with ASCE 24.

    G114.5 Flood-damage-resistant materials. Flood-damage-resistant materials shall be used below the design flood elevation.

    G114.6 Protection of mechanical, plumbing and electrical systems. Mechanical, plumbing and electrical systems, including plumbing fixtures, shall be elevated to or above the design flood elevation.

    SECTION 1.8.10—OTHER BUILDING REGULATIONS

    1.8.10.1 Existing structures. Notwithstanding other provisions of law, the replacement, retention and extension of original materials and the use of original methods of construction for any existing building or accessory structure, or portions thereof, shall be permitted in accordance with the provisions of this code and the California Existing Building Code, as adopted by the Department of Housing and Community Development. For additional information, see California Health and Safety Code, Sections 17912, 17920.3, 17922 and 17958.8.

    1.8.10.2 Moved structures. Subject to the requirements of California Health and Safety Code Sections 17922, 17922.3 and 17958.9, local ordinances or regulations relating to a moved residential building or accessory structure thereto, shall permit the replacement, reten- tion and extension of original materials and the use of original methods of construction so long as the structure does not become or continue to be a substandard building.

    SECTION 1.9—DIVISION OF THE STATE ARCHITECT

    1.9.1 Division of the State Architect—Access Compliance.

    General. The purpose of this code is to ensure that barrier-free design is incorporated in all buildings, facilities, site work and other improvements to which this code applies in compliance with state law to ensure that these improvements are accessible to and usable by persons with disabilities. Additions, alterations and structural repairs in all buildings and facilities shall comply with these provisions for new buildings, except as otherwise provided and specified herein.

    The provisions of these regulations shall apply to any portable buildings leased or owned by a school district, and shall also apply to temporary and emergency buildings and facilities. Temporary buildings and facilities are not of permanent construction but are exten- sively used or are essential for public use for a period of time. Examples of temporary buildings or facilities covered include, but are not limited to: reviewing stands, temporary classrooms, bleacher areas, exhibit areas, temporary banking facilities, temporary health screening services or temporary safe pedestrian passageways around a construction site.

    In addition, to incorporate standards at least as restrictive as those required by the federal government for barrier-free design under (1) Title III (Public Accommodations and Commercial Facilities), Subpart D (New Construction and Alteration) (see 28 C.F.R., Part 36), and (2) Title II (Public Entities), Section 35.151 (New Construction and Alterations) (see 28 C.F.R., Part 35) both from the Americans with Disabilities Act of 1990, 2004 Americans with Disabilities Act Accessibility Guidelines, as adopted by the U.S. Department of Justice (see 36 C.F.R. Part 1191, Appendices B and D), and (3) under the Fair Housing Amendments Act of 1988. Some of these regulations may be more stringent than state law in order to meet the federal requirement.

    1.9.1.1 Application. See Government Code commencing with Section 4450.

Frequently asked questions

What if I need a temporary structure for longer than 180 days?

You must request an extension from the building official and show demonstrated cause (safety documentation, inspection records, etc.). The building official has discretion to grant or deny the extension. See § R107.1.

Do temporary structures have to meet the same fire and egress rules as permanent buildings?

Yes — temporary structures must conform to necessary structural, fire safety and means-of-egress requirements to protect health and safety, as required by § R107.2.

Can I get temporary power before final inspection?

Yes; the building official can permit temporary power to part of an installation if it meets the applicable temporary-power rules and the California Electrical Code, per § R107.3.

Are there faster rules for emergency temporary uses?

Yes. Appendix E (Existing Building Code) contains provisions for temporary emergency uses and expedited permit submission during emergencies; those rules are applied when an emergency triggers them.

Do special-event tents follow the same 180‑day rule?

Special-event temporary structures often have their own limits and requirements (for instance, different short-term use periods and inspection/operations plans in the CBC and Fire Code).
