Overview

This area of the California Residential Code (CRC) covers who enforces the one- and two‑family dwelling rules and what those officials may do to ensure code compliance. Chapter 1 (Division II) sets the scope and establishes the authority and duties of the building official and the authority having jurisdiction, including the basic enforcement framework in §R101 and the administrative structure for the chapter as a whole.

Practically, the provisions identify the building official’s powers to issue permits (§R105), make determinations and interpretations (§R104), conduct inspections (§R109), and issue certificates of occupancy (§R110) as well as notices, orders and stop‑work actions (§R113–§R114). They also require official records and set out liability and legal‑defense protections for code officials (§R104.6–R104.8).

Because the CRC is adopted into state regulation, the CRC’s authority and duties language works alongside state agency delegation and specialized enforcement (for example, State Fire Marshal or HCD applications) — see the state adoption and agency duty provisions in Chapter 1 and related sections.

    It is important to understand that the IRC contains coverage for what is conventional and common in residential construction practice. While the IRC will provide all of the needed coverage for most residential construction, it might not address construction practices and systems that are atypical or rarely encountered in the industry. Therefore, the IRC contains several references to other codes either as an alternative to the provisions of the IRC or where the IRC lacks coverage for a particular type of structure, design, system, appliance or method of construction. In other words, the IRC is meant to be all inclusive for typical residential construction and it relies on other codes only where alternatives are desired or where the code lacks coverage for the uncommon aspect of residential construction. Of course, the IRC constantly evolves to address new technologies and construction practices that were once uncommon, but are now common.

    The IRC is unique in that much of it, including Chapters 3 through 9 and Chapters 34 through 43, is presented in an ordered format that is consistent with the normal progression of construction, starting with the design phase and continuing through the final trimout phase. This is consistent with the “cookbook” philosophy of the IRC.

    Arrangement and Format of the 2025 CRC

    The CRC is divided into nine main parts, specifically: Part I—Administrative, Part II—Definitions, Part III—Building Planning and Construction, Part IV—Energy Conservation, Part V—Mechanical, Part VI—Fuel Gas, Part VII—Plumbing, Part VIII—Electrical and Part IX—Referenced Standards. Parts IV through VIII of IRC are not adopted in California and replaced with references to appropriate parts of Title 24. The following provides a brief description of the content of each chapter and appendix of the CRC:

    Chapter 1 Scope and Administration.

    Chapter 1 establishes the limits of applicability of the code and describes how the code is to be applied and enforced. The provisions of Chapter 1 establish the authority and duties of the code official appointed by the authority having jurisdiction and also establish the rights and privileges of the design professional, contractor and property owner.

    Chapter 2 Definitions.

    Chapter 2 is the repository of the definitions of terms used in the body of the code. The user of the code should be familiar with and consult this chapter because the definitions are essential to the correct interpretation of the code and because the user may not be aware that a term is defined.

    Chapter 3 Building Planning.

    Chapter 3 provides guidelines for a minimum level of structural integrity, life safety, fire safety and livability for inhabitants of dwelling units regulated by this code. Chapter 3 is a compilation of the code requirements specific to the building planning sector of the design and construction process. This chapter sets forth code requirements dealing with light, ventilation, sanitation, minimum room size, ceiling height and environmental comfort. Chapter 3 establishes life-safety provisions including limitations on glazing used in hazardous areas, specifications on stairways, use of guards at elevated surfaces, window and fall protection, and rules for means of egress. Snow, wind and seismic design live and dead loads and flood-resistant construction, as well as solar energy systems are addressed in this chapter.

    1.11.5 Inspections. Work performed subject to the provisions of this code shall comply with the inspection requirements of Sections R109.1 through R109.1.6.

    1.11.5.1 Existing Group I -1 or R occupancies. Licensed 24-hour care in a Group I-1 or R occupancy in existence and originally classi- fied under previously adopted state codes shall be reinspected under the appropriate previous code, provided there is no change in the use or character which would place the facility in a different occupancy group.

    1.11.6 Certificate of occupancy. A certificate of occupancy shall be issued as specified in Section R110.

    1.11.7 Temporary structures and uses. See Section R107.

    1.11.8 Service utilities. See Section R111.

    1.11.9 Stop work order. See Section R114.

    1.11.10 Unsafe buildings, structures and equipment. See Title 24, Part 2, California Building Code, Section 115.

    DIVISION II SCOPE AND ADMINISTRATION

    About this chapter: Chapter 1 Division II establishes the limits of applicability of this code and describes how the code is to be applied and enforced. Chapter 1 Division II is in two parts: Part 1—Scope and Application (Sections R101–R102) and Part 2—Administration and Enforcement (Sections R103–R114). Section R101 identifies which buildings and structures come under its purview and references other I-Codes as applicable. Standards and codes are scoped to the extent referenced (see Section R102.4).

    The one- and two-family dwelling code is intended to be adopted as a legally enforceable document, and it cannot be effective without adequate provisions for its administration and enforcement. The provisions of Chapter 1 establish the authority and duties of the building official appointed by the authority having jurisdiction and also establish the rights and privileges of the design professional, contractor and property owner.

    Division II is not adopted by the Department of Housing and Community Development except where specifically indicated. Note: Specific sections of Chapter 1, Division II adopted by the State Fire Marshal will be indicated in the Matrix Adoption Table.

    PART 1—SCOPE AND APPLICATION

    SECTION R101—SCOPE AND GENERAL REQUIREMENTS

    R101.1 Title. These provisions shall be known as the Residential Code for One- and Two-family Dwellings of [ NAME OF JURISDICTION ], and shall be cited as such and will be referred to herein as “this code.”

    R104.6 Notices and orders. The building official shall issue necessary notices or orders to ensure compliance with this code. Notices of violations shall be in accordance with Section R113.2.

    R104.7 Official records. The building official shall keep official records as required in Sections R104.7.1 through R104.7.5. Such official records shall be retained for not less than 5 years or for as long as the building or structure to which such records relate remains in existence, unless otherwise provided by other regulations.

    R104.7.1 Approvals. A record of approvals shall be maintained by the building official and shall be available for public inspection during business hours in accordance with applicable laws.

    R104.7.2 Inspections. The code official shall have the authority to conduct inspections, or shall accept reports of inspection by approved agencies or individuals. Reports of such inspections shall be in writing and be certified by a responsible officer of such approved agency or by the responsible individual. The building official shall keep a record of each inspection made, including notices and orders issued, showing the findings and disposition of each.

    R104.7.3 Code alternatives and modifications. Application for alternative materials, design and methods of construction and equipment in accordance with Section R104.2.2; modifications in accordance with Section R104.2.3; and documentation of the final decision of the building official for either shall be in writing and shall be retained in the official records.

    R104.7.4 Tests. The building official shall keep a record of tests conducted to comply with Section R104.2.2.5.

    R104.7.5 Fees. The building official shall keep a record of fees collected and refunded in accordance with Section R108.

    R104.8 Liability. The building official, member of the board of appeals or employee charged with the enforcement of this code, while acting for the jurisdiction in good faith and without malice in the discharge of the duties required by this code or other pertinent law or ordinance, shall not thereby be personally liable, either civilly or criminally, and is hereby relieved from personal liability for any damage accruing to persons or property as a result of an act or by reason of any act or omission in the discharge of official duties.

    R104.8.1 Legal defense. Any suit or criminal complaint instituted against an officer or employee because of an act performed by that officer or employee in the lawful discharge of duties and under the provisions of this code or other laws or ordinances implemented through the enforcement of this code shall be defended by legal representatives of the jurisdiction until the final termination of the proceedings. The building official or any subordinate shall not be liable for cost in any action, suit or proceeding that is instituted in pursuance of the provisions of this code.

    R104.9 Approved materials and equipment. Materials, equipment and devices approved by the building official shall be constructed and installed in accordance with such approval.

    R104.9.1 Materials and equipment reuse. Materials, equipment and devices shall not be reused unless such elements are in good working condition and approved.

    1.8.2.1.3 Permanent buildings in mobilehome parks and special occupancy parks.

    Application— Permanent buildings, and permanent accessory buildings or structures, constructed within mobilehome parks and special occupancy parks that are under the control and ownership of the park operator. Sections of this code which pertain to applications listed in this section are identified using the abbreviation “HCD 2.”

    SECTION 1.8.3—LOCAL ENFORCING AGENCY

    1.8.3.1 Duties and powers. The building department of every city, county, or city and county shall enforce all the provisions of law, this code, and the other rules and regulations promulgated by the Department of Housing and Community Development pertaining to the installation, erection, construction, reconstruction, movement, enlargement, conversion, alteration, repair, removal, demolition or

    arrangement of apartments, condominiums, hotels, motels, lodging houses and dwellings, including accessory buildings, facilities and uses thereto.

    The provisions regulating the erection and construction of dwellings and appurtenant structures shall not apply to existing structures as to which construction is commenced or approved prior to the effective date of these regulations. Requirements relating to use, main- tenance and occupancy shall apply to all dwellings and appurtenant structures approved for construction or constructed before or after the effective date of this code.

Members shall be represented by legal counsel at the jurisdiction’s expense in all matters arising from service within the scope of their duties.

The procedures shall not require compliance with strict rules of evidence, but shall mandate that only relevant information be presented.

    AA101.3.1 Qualifications. The board shall consist of five individuals, who are qualified by experience and training to pass on matters pertaining to building construction and are not employees of the jurisdiction.

    AA101.3.2 Alternate members. The chief appointing authority is authorized to appoint two alternate members who shall be called by the board chairperson to hear appeals during the absence or disqualification of a member. Alternate members shall possess the qualifications required for board membership, and shall be appointed for the same term or until a successor has been appointed.

    AA101.3.3 Vacancies. Vacancies shall be filled for an unexpired term in the same manner in which original appointments are required to be made.

    AA101.3.4 Chairperson. The board shall annually select one of its members to serve as chairperson.

    AA101.3.5 Secretary. The chief appointing authority shall designate a qualified clerk to serve as secretary to the board. The secretary shall file a detailed record of all proceedings which shall set forth the reasons for the board’s decision, the vote of each member, the absence of a member and any failure of a member to vote.

    AA101.3.6 Conflict of interest. A member with any personal, professional or financial interest in a matter before the board shall declare such interest and refrain from participating in discussions, deliberations and voting on such matters.

    AA101.3.7 Compensation of members. Compensation of members shall be determined by law.

    AA101.3.8 Removal from the board. A member shall be removed from the board prior to the end of their term only for cause. Any member with continued absence from regular meeting of the board may be removed at the discretion of the chief appointing authority.

    103.0 Duties and Powers of the Authority Having Jurisdiction.

    103.1 General. The Authority Having Jurisdiction shall be the Authority duly appointed to enforce this code. For such purposes, the Authority Having Jurisdiction shall have the powers of a law enforcement officer. The Authority Having Jurisdiction shall have the power to render interpretations of this code and to adopt and enforce rules and regulations supplemental to this code as deemed necessary in order to clarify the application of the provisions of this code. Such interpretations, rules, and regulations shall comply with the intent and purpose of this code.

    In accordance with the prescribed procedures and with the approval of the appointing authority, the Authority Having Jurisdiction shall be permitted to appoint a such number of technical officers, inspectors, and other employees as shall be authorized from time to time. The Authority Having Jurisdiction shall be permitted to deputize such inspectors or employees as necessary to carry out the functions of the code enforcement agency.

    The Authority Having Jurisdiction shall be permitted to request the assistance and cooperation of other officials of this jurisdiction so far as required in the discharge of the duties in accordance with this code or other pertinent law or ordinance.

    103.2 Liability. The Authority Having Jurisdiction charged with the enforcement of this code, acting in good faith and without malice in the discharge of the Authority Having Jurisdiction’s duties, shall not thereby be rendered personally liable for damage that accrues to persons or property as a result of an act or by reason of an act or omission in the discharge of duties. A suit brought against the Authority Having Jurisdiction or employee because of such act or omission performed in the enforcement of provisions of this code shall be defended by legal counsel provided by this jurisdiction until final termination of such proceedings.

    103.3 Applications and Permits. The Authority Having Jurisdiction shall be permitted to require the submission of plans, specifications, drawings, and such other information in accordance with the Authority Having Jurisdiction, prior to the commencement of, and at a time during the progress of, work regulated by this code.

    The issuance of a permit upon construction documents shall not prevent the Authority Having Jurisdiction from thereafter requiring the correction of errors in said construction documents or from preventing construction operations being carried on thereunder where in violation of this code or of other pertinent ordinance or from revoking a certificate of approval where issued in error.

    103.3.1 Licensing. Provision for licensing shall be determined by the Authority Having Jurisdiction. 103.4 Right of Entry. Where it is necessary to make an inspection to enforce the provisions of this code, or where the Authority Having Jurisdiction has reasonable cause to believe that there exists in a building or upon premises a condition or violation of this code that makes the building or premises unsafe, insanitary, dangerous, or hazardous, the Authority

    Having Jurisdiction shall be permitted to enter the building or premises at reasonable times to inspect or to perform the duties imposed by the Authority Having Jurisdiction by this code, provided that where such building or premises is occupied, the Authority Having Jurisdiction shall present credentials to the occupant and request entry. Where such building or premises is unoccupied, the Authority Having Jurisdiction shall first make a reasonable effort to locate the owner or other person having charge or control of the building or premises and request entry. Where entry is refused, the Authority Having Jurisdiction has recourse to every remedy provided by law to secure entry.

    1.11.2 Duties and powers of the enforcing agency.

    1.11.2.1 Enforcement.

    1.11.2.1.1 The responsibility for enforcement of building standards adopted by the State Fire Marshal and published in the California Building Standards Code relating to fire and panic safety and other regulations of the State Fire Marshal shall except as provided in Section 1.11.2.1.2 be as follows: 1. The city, county, or city and county with jurisdiction in the area affected by the standard or regulation shall delegate the enforcement of the building standards relating to fire and panic safety and other regulations of the State Fire Marshal as they relate to Group R-3 occupancies, as described in Section 1.1.3.1 or SFM Part 2 California Building Code, Section _310.

    1270.04 Provisions for application of these regulations. This Subchapter shall be applied as follows: (a) the Local Jurisdictions shall provide the Director of the California Department of Forestry and Fire Protection (CAL FIRE) or their designee with notice of applications for Building permits, tentative parcel maps, tentative maps, and installation or use permits for construction or Development within the SRA, or if after July, 1 2021, the VHFHSZ. (b) the Director or their designee may review and make fire protection recommendations on applicable construction or develop- ment permits or maps provided by the Local Jurisdiction. (c) the Local Jurisdiction shall ensure that the applicable sections of this Subchapter become a condition of approval of any appli- cable construction or Development permit or map.

    1270.05 Local regulations. (a) Subchapter 2 shall serve as the minimum Wildfire protection standards applied in SRA and VHFHSZ. However, Subchapter 2 does not supersede local regulations which equal or exceed the standards of this Subchapter. (b) A local regulation equals or exceeds a minimum standard of this Subchapter only if, at a minimum, the local regulation also fully complies with the corresponding minimum standard in this Subchapter. (c) A Local Jurisdiction shall not apply exemptions to Subchapter 2 that are not enumerated in Subchapter 2. Exceptions requested and approved in conformance with § 1270.07 (Exceptions to Standards) may be granted on a case-by-case basis. (d) Notwithstanding a local regulation that equals or exceeds the State Minimum Fire Safe Regulations, Building construction shall comply with the State Minimum Fire Safe Regulations.

    1270.06 Inspections. Inspections shall conform to the following requirements: (a) Inspections in the SRA shall be made by: (1) the Director, or (2) Local Jurisdictions that have assumed state fire protection responsibility on SRA lands, or (3) Local Jurisdictions where the inspection duties have been formally delegated by the Director to the Local Jurisdictions, pursuant to subsection (b). (b) The Director may delegate inspection authority to a Local Jurisdiction subject to all of the following criteria: (1) The Local Jurisdiction represents that they have appropriate resources to perform the delegated inspection authority. (2) The Local Jurisdiction acknowledges that CAL FIRE's authority under subsection (d) shall not be waived or restricted. (3) The Local Jurisdiction consents to the delegation of inspection authority. (4) The Director may revoke the delegation at any time. (5) The delegation of inspection authority, and any subsequent revocation of the delegation, shall be documented in writ- ing, and retained on file at the CAL FIRE Unit headquarters that administers SRA fire protection in the area. (c) Inspections in the VHFHSZ shall be made by the Local Jurisdiction. (d) Nothing in this section abrogates CAL FIRE's authority to inspect and enforce state forest and fire laws in the SRA even when the inspection duties have been delegated pursuant to this section. (e) Reports of violations within the SRA shall be provided to the CAL FIRE Unit headquarters that administers SRA fire protection in the Local Jurisdiction.

Who is the "authority having jurisdiction" (AHJ) under the CRC?

The AHJ is the entity appointed to enforce the code in a jurisdiction (typically the local building department or delegated state agency). The CRC explains the AHJ’s role and delegation of duties in Chapter 1 (see §R101 and related administration provisions).

What routine powers does the building official have?
