Reinspection fees, failed inspections, and inspector responsibilities

If an inspection is called before the work is ready, plans aren’t available, access isn’t provided, or required corrections aren’t made, the local authority may charge a reinspection fee and will not re-inspect until it’s paid; the CPC authorizes this in **§ 105.2.6** and gives the AHJ authority to require other inspections under **§ 105.2.2** — check your jurisdiction’s Table 104.5 for the actual fee amount.

What the code requires — 2–4 sentences

The California Plumbing Code allows the Authority Having Jurisdiction (AHJ) to require other inspections and to assess a reinspection fee when work is not ready or corrections have not been made. The controlling text is § 105.2.2 (authority to require other inspections) and § 105.2.6 (reinspections and reinspection fees). § 105.2.6 explains when reinspection fees are permitted and that no additional inspections will be performed until the fee is paid.

The single most important rule: If an inspection is called when the work is not ready or required corrections aren’t made, the AHJ may charge a reinspection fee and may refuse further inspection until the fee is paid. § 105.2.6.

Administrative procedure for reinspection

Exceptions & special cases

  • The code explicitly states that the reinspection-fee allowance shall not be interpreted to require reinspection fees for the first time a job is rejected for nonconformance. In plain terms, jurisdictions should not impose a reinspection fee automatically on the initial rejection. § 105.2.6.
  • The CPC does not set dollar amounts for reinspection fees in the text; instead it points to the fee table and leaves amounts to the adopting jurisdiction (see Table 104.5). If you need the exact dollar amount, check the local fee schedule. Table 104.5 shows the line item for Reinspection fee and notes the jurisdiction will indicate its fees.

Common mistakes

  • Assuming every failed inspection triggers a fee. The code does not require a fee for the first rejection; fees are intended to discourage repeated calls when the job is not ready. § 105.2.6.
  • Failing to bring approved plans to the inspection. The AHJ may assess a reinspection fee if plans are not readily available. § 105.2.6.
  • Not understanding who must pay. The permit holder / person requesting inspection is responsible to provide access and the equipment/assistance for inspection; they are also the party who must pay the reinspection fee to obtain another inspection. § 105.2.3, § 105.2.5, § 105.2.6.
  • Calling for inspection before corrections are actually completed (common on busy jobs) — the code treats that practice as a reason to allow reinspection fees. § 105.2.6.

Worked example — concrete scenario with numbers (hypothetical fee)

Scenario: A contractor holds a permit for a bathroom remodel. The jurisdiction’s adopted fee schedule (Table 104.5) sets the reinspection fee at $75 per visit (this $75 is a hypothetical example — local amounts vary and Table 104.5 in the jurisdiction will show the actual fee).

  1. First final plumbing inspection: inspector discovers a leaking tub waste connection and issues a rejection (i.e., failed inspection). According to the CPC, the AHJ should not assess a reinspection fee simply because this is the first rejection. § 105.2.6.
  2. Contractor fixes the leak and schedules a reinspection. If the contractor calls for inspection again but the inspector finds the leak still present (or the work otherwise not ready), the AHJ may assess the reinspection fee (here, $75) for that failed follow-up visit. § 105.2.6.
  3. The contractor must pay the $75 and file the written application for reinspection (or follow the local reinspection process) before another inspection is scheduled. The code says no additional inspection will be performed until the required fees have been paid. § 105.2.6.

Note: Substitute your local jurisdiction’s actual reinspection fee from Table 104.5 when calculating real costs; the CPC itself leaves the amount to the jurisdiction.

    No test or inspection shall be required where a plumbing system, or part thereof, is set up for exhibition purposes and has no connection with a water or drainage system. In cases where it would be impractical to provide the required water or air tests, or for minor installations and repairs, the Authority Having Jurisdiction shall be permitted to make such inspection as deemed advisable in order to be assured that the work has been performed in accordance with the intent of this code. Joints and connections in the plumbing system shall be gastight and watertight for the pressures required by the test. 105.3.1 Defective Systems. An air test shall be used in testing the sanitary condition of the drainage or plumbing system of building premises where there is reason to believe that it has become defective. In buildings or premises condemned by the Authority Having Jurisdiction because of an insanitary condition of the plumbing system, or part thereof, the alterations in such system shall be in accordance with the requirements of this code. 105.3.2 Retesting. Where the Authority Having Jurisdiction finds that the work will not pass the test, necessary corrections shall be made, and the work shall be resubmitted for test or inspection. 105.3.3 Approval. Where prescribed tests and inspections indicate that the work is in accordance with this code, a certificate of approval shall be issued by the Authority Having Jurisdiction to the permittee on demand. 105.4 Connection to Service Utilities. No person shall make connections from a source of energy or fuel to a plumbing system or equipment regulated by this code and for which a permit is required until approved by the Authority Having Jurisdiction. No person shall make connection from a watersupply line nor shall connect to a sewer system regulated by this code and for which a permit is required until approved by the Authority Having Jurisdiction. The Authority Having Jurisdiction shall be permitted to authorize temporary connection of the plumbing equipment to the source of energy or fuel for the purpose of testing the equipment.

    [A] 109.1.1 General. Construction or work for which a permit is required by this code shall be subject to inspection by the code official and such construction or work shall remain visible and able to be accessed for inspection purposes until approved by the code official.

    It shall be the duty of the permit applicant to cause the work to remain visible and able to be accessed for inspection purposes. Neither the code official nor the jurisdiction shall be liable for expense entailed in the removal or replacement of any material required to allow inspection.

    Approval as a result of an inspection shall not be construed to be an approval of a violation of the provisions of this code or of other ordinances of the jurisdiction. Inspections presuming to give authority to violate or cancel the provisions of this code or of other ordinances of the jurisdiction shall not be valid.

    Where required by the code official, a survey of the lot shall be provided to verify that the mitigation features are provided and the building or structure is located in accordance with the approved plans.

    [A] 109.1.2 Authority to inspect. The code official shall inspect, as often as necessary, buildings and premises, including such other hazards or appliances designated by the code official for the purpose of ascertaining and causing to be corrected any conditions that could reasonably be expected to cause fire or contribute to its spread, or any violation of the purpose of this code and of any other law or standard affecting fire safety.

    [A] 109.1.2.1 Approved inspection agencies. The code official is authorized to accept reports of approved inspection agencies, provided that such agencies satisfy the requirements as to qualifications and reliability.

No person shall make connections from a source of energy or fuel to a mechanical system or equipment regulated by this code and for which a permit is required until approved by the Authority Having Jurisdiction. The Authority Having Jurisdiction shall be permitted to authorize temporary connection of the mechanical system equipment to the source of energy or fuel for the purpose of testing the equipment.

Frequently asked questions

Who decides whether a reinspection fee applies?

The local Authority Having Jurisdiction (AHJ) decides when conditions in § 105.2.6 are met and may assess a reinspection fee accordingly.

Is a reinspection fee always charged after a failed inspection?

No. The code states that a reinspection fee shall not be interpreted to require a fee for the first time a job is rejected. Fees are intended for repeat calls or avoidable situations listed in § 105.2.6.

What must I do before another inspection is scheduled after a fee is assessed?

You must file the jurisdiction’s reinspection application (the local form) and pay the reinspection fee listed in Table 104.5; the AHJ will not perform additional inspections until the fee is paid. § 105.2.6.

Where are the reinspection fee amounts shown?

Reinspection fee line items appear in Table 104.5 of the CPC; jurisdictions fill in the actual dollar amounts there. The CPC does not fix the dollar amounts itself.

If the inspector can’t access the site, can they charge a fee?

Yes — the code permits assessing a reinspection fee when access is not provided on the date the inspection is requested. § 105.2.6.
