2.18.010 - Appointment of city clerk.

On November 3, 2009 the voters of the city of Willits passed Measure B, making the position of city clerk appointive rather than elective. Pursuant to Government Code Section 36510 the city council shall appoint the city clerk to serve at the pleasure of the city council. It is not required that the city clerk be a resident or an elector of the city of Willits. The city clerk shall be appointed by the city council, upon the recommendation of the city manager, on the basis of knowledge, administrative qualifications, experience and understanding of municipal government and applicable city, state and federal law.

2.18.020 - Responsibilities and duties.

The city clerk shall perform all of the duties and responsibilities imposed upon him or her as city clerk as required by law. The city clerk shall coordinate his/her work with the city manager so that the city clerk's work will be of assistance to the city manager in the city manager's general administration of the city. The city manager shall retain the administrative authority in all city matters, and in this connection, shall exercise supervisorial direction over the city clerk. The general duties of the city clerk include, but are not limited to, the following:

A. City Clerk. The city clerk shall serve as clerk to the city council; attend council meetings; and maintain and preserve the minutes and records of the proceedings of the city council and of all committees, boards and commissions in accordance with all general laws of the state of California.

B. Agenda Preparation. The city clerk shall direct the preparation, organization, printing and distribution of the agenda for the city council meetings.

C. Ordinances and Resolutions. The city clerk shall index, record and certify the ordinances and resolutions of the city council and be the legal custodian of the same.

D. Municipal Code. The city clerk shall codify ordinances and maintain the municipal code.

E. Records Management. The city clerk shall plan and direct the maintenance, filing, disposition and preservation of official documents and, in accordance with legal requirements, develop and administer a records management system.

F. Administer Oaths. The city clerk shall administer the oath of office to elected and appointed officials.

G. Elections and Filing Officer. The city clerk shall keep and maintain all local election records and have custody of all property used in connection with elections. The city clerk shall also serve as the filing officer for fair political practices commission forms and notices.

H. Publish Notices. The city clerk shall publish all legal notices as required by law or ordinance.

I. Receive Claims. The city clerk shall receive all claims, amendments thereto or applications for leave to file late claims against the city.

J. Other Duties Required by Law. The city clerk shall perform such other duties as may be prescribed by law or ordinance.

2.18.030 - Bond.

The city clerk shall execute a surety body to the city which shall conform to the provisions of the Government Code relating to bonds of public officers. The penal sum of the bond shall be in a reasonable amount and fixed by the city council, by resolution. Any premium for such bond shall be a proper charge against the city.

2.18.040 - Salary.

The salary of the city clerk shall be set by resolution of the city council pursuant to Government Code Section 36517. The city clerk's salary may be amended from time to time by subsequent resolution.
