§ 2.32.010. Peace officer standards and training.

A. The city declares that it desires to qualify to receive aid from the state under provisions of Chapter 1 of Title 4, part 4 of the California Penal Code.

B. Pursuant to Section 13522 of said Chapter 1, the city, while receiving aid from the state pursuant to said Chapter 1, will adhere to the standards for recruitment and training established by the California Commission of Peace Officer Standards and Training.

§ 2.32.020. Disposition of unclaimed property.

Whenever any department has in its possession any personal property, the ownership of which is unknown, the department shall retain the property in its possession for a minimum period of ninety days from the date on which it came into possession of the department, during which time the police department shall make reasonable effort to ascertain the identity of the owner thereof, and, should the identity and address of such owner be ascertained, shall give notice to such owner by mail of the fact that the property is in the possession of the department, and that the owner, upon satisfactorily identifying him or herself and his or her ownership, will be entitled to receive the property. If, during the ninety-day period, the department is unable to ascertain the name and address of the owner of such property, and no person or persons makes claims thereto and prove their ownership, the chief of police shall cause such property to be sold at public auction to the highest bidder for cash. The proceeds from the sale shall be deposited by the department head with the city treasurer as a miscellaneous receipt.

§ 2.32.030. Police department service charges.

The city hereby authorizes and establishes service charges for the police department in order to recover the costs of providing department services of a limited nature from those utilizing those services, so that general tax revenues are not diverted from general services of a broad nature to be used to subsidize such limited services. The service charges shall be levied to recover or partially recover the police department's costs and expenses reasonably incurred in providing services and tasks that are of special benefit to the recipient of the service, but that do not provide general benefits to the public at large. The types and amounts of police department service charges shall be determined, levied and adjusted from time to time by resolution of the city council.

§ 2.32.040. Military equipment.

A. The military equipment use policy developed by the Wheatland police department and approved by the city council, or any amended policy, shall govern the use of military equipment by the Wheatland police department.

B. The policy shall be made publicly available on the Wheatland police department's website if the policy authorizes the use of any military equipment by the Wheatland police department.

C. The Wheatland police department shall submit an annual military equipment report to the city council containing the information required by Government Code Section 7072 and the city council shall thereafter determine whether each type of military equipment identified in the report, if any, complied with the standards of approval set forth in Government Code Section 7071, subdivision (d).

D. The city council shall, on an annual basis at a regular meeting, review this section and vote on whether to renew it pursuant to Government Code Section 7071, subdivision (e)(2).

E. The definitions set forth in Government Code Section 7070 shall apply to this section.
