1-13-1: CLAIMS:

The Council must not hear or consider any claim in favor of any person, against the City, nor shall the Council credit or allow any claim or bill against the City, unless the same is itemized, giving names, dates and particular service rendered, character of work done, number of days engaged, supplies or materials furnished, to who and quantity and price therefor, duly verified to be correct and that the amount claimed is justly due.

No account shall be passed upon Council unless made out as prescribed in this and the preceding Section, and filed with the Clerk three (3) days prior to the time of the meeting of the Council at which it is asked to be allowed. (Ord. 73, 4-5-1915)

1-13-2: SECTION 1094.6, CODE OF CIVIL PROCEDURE APPLICABLE IN CITY:

(A) Section 1094.6 of the Code of Civil Procedure of the State relating to time for filing writs of mandate, shall be and is applicable in the City.

(B) The provisions of such section shall prevail over any conflicting provision in any otherwise applicable law relating to the subject matter. (Ord. 480, 11-15-1983)

1-13-3: APPLICATION OF SECTION 1094.6:

In addition to any other applications, section 1094.6 of the Code of Civil Procedure applies to decisions made, after hearing, suspending, demoting or dismissing an officer or employee, revoking or denying an application for a permit or a license, or denying an application for any retirement benefit or allowance. (Ord. 480, 11-15-1983)

1-13-4: CLAIMS AGAINST CITY:

Notwithstanding the exemptions set forth in section 905 of the Government Code of the State, all claims against the City for damages or money, when a procedure for processing such claims is not otherwise provided by State or local laws, regulations or ordinances, shall be presented within the time limitations and in the manner described by sections 910 through 915.2 of the Government Code of the State. Such claims shall further be subject to the provisions of sections 945 through 946 of the Government Code of the State relating to the prohibition of suits in the absence of the presentation of claims, along with action thereon by the City Council of the City.
