§ 5.10.010. Business License Exemption.

It is recognized that garage and yard sales, rummage sales, the sale of property from residential estates are a part of community life; provided such sales do not become commercialized and are limited in duration. Therefore, because these sales are not intended to be run as a business, but are for the convenience of the residential tenant, they are exempt from obtaining a business license or permit. § 5.10.020. Purpose and Intent.

It is the intent of these regulations to allow reasonable use of residential properties in town for the purpose of selling goods and items on a very limited basis and to control such sales in order to maintain the amenities of the community and control on-street parking. These regulations are needed for the protection of the residential and mixed use environment within Sand City. (Ord. 12-03 §2)

§ 5.10.030. Definitions.

For the purposes of this chapter, the terms listed in this section are defined as follows:

"Estate sales" shall mean sales of personal property and goods from the estate of a deceased person, sold from the residence of the deceased person.

"Garage and yard sales" shall mean sales conducted by individuals in their homes and/or on their properties for the purpose of disposing of personal property no longer needed by the individual or family residing on the property. Garage and yard sales may, at times, be conducted by a group of residents at a single location.

"Rummage sales" shall mean sales conducted by groups of individuals or non-profit organizations to raise funds for charitable purposes through the sale of donated articles of clothing, art objects, household goods and the like. (Ord. 12-03 §3)

§ 5.10.040. Regulation of Sales.

A. Not more than two garage/yard/rummage sales shall be permitted on any building site or property within any consecutive 12 month period. No garage/yard sale shall be conducted for more than two consecutive days.

B. Estate sales may be permitted only on the property belonging to the estate for which the sales is held and the property and goods sold at such sale shall be a part of the estate.

C. It is unlawful to conduct any estate sale, garage or yard sale or rummage sale in violation of this chapter or any other applicable law or regulation. (Ord. 12-03 §4)
