Sec. 90-736. - License required.

No person residing in the city shall operate or use a bicycle upon any street or public highway in the city unless such bicycle has been duly licensed as provided in this division. For the purposes of this division, the term "bicycle" shall also include a motorized bicycle.

Sec. 90-737. - Acquisition of forms.

The licensing agency shall procure from the state department of motor vehicles the necessary bicycle license and license renewal indicia as well as registration certificates or other forms required by state law for the licensing of bicycles.

Sec. 90-738. - Schedule of fees.

The fees required to be paid pursuant to this division are as follows:

(1) For each new bicycle license and registration certificate, $2.00.

(2) For each transfer of a registration certificate, $1.00.

(3) For each replacement of a bicycle license or registration certificate, $1.00.

(4) For each bicycle license renewal, $1.00.

Sec. 90-739. - Issuance of forms.

(a) At the time that any person licenses a bicycle and pays the established license fee in accordance with this division, the licensing agency shall provide a registration certificate bearing the following:

(1) The date;

(2) The owner's name, address, telephone number;

(3) The bicycle license number;

(4) The date the bicycle license was issued;

(5) The bicycle manufacturer, type and frame number; and

(6) Any other descriptive material concerning the bicycle deemed necessary by the licensing agency.

(b) In addition to subsection (a) of this section, at the time of licensing, the bicycle owner shall be issued a permanent bicycle license bearing the unique number reflecting the proper indicia procured from the director of motor vehicles pursuant to Vehicle Code § 39001.

Sec. 90-740. - Licensing upon request.

Any bicycle not subject to this article may be licensed upon request of the owner.

Sec. 90-741. - Preregistration form; information required for retail sale.

(a) In accordance with Vehicle Code § 39006, each bicycle retailer and each bicycle dealer shall supply to each purchaser a preregistration form provided by the licensing agency and shall include, on the sales check or receipt given to the purchaser, a record of the following information:

(1) The name of the retailer;

(2) The address of the retailer;

(3) The year and make of the bicycle;

(4) The serial number of the bicycle if delivered to the purchaser in an assembled state;

(5) A general description of the bicycle;

(6) The name of the purchaser; and

(7) The address of the purchaser.

(b) A copy of the preregistration form shall be filled out and forwarded by the purchaser to the licensing agency within ten days of the date of sale.

Sec. 90-742. - Monthly sales reports required from bicycle dealers.

Any bicycle dealer within the city is required to make a monthly report to the licensing agency giving the name, address and telephone number of all persons either buying, selling or trading new or used bicycles and the bicycle manufacturer, type, frame number, and bicycle license number, if any.

Sec. 90-743. - Transfer reports required.

(a) Seller or transferor. It shall be the duty of every person who sells or otherwise disposes of any bicycle or bicycle frame to endorse upon the registration certificate issued for such bicycle or bicycle frame a written transfer thereof setting forth the name, address and telephone number of the transferee; the date of transfer; and the signature of the transferor; and to report such sale or transfer of ownership by delivery of the registration certificate so endorsed to the licensing agency within ten days of the date of such sale or disposition.

(b) Buyer or transferee. It shall be the duty of any person who purchases or otherwise acquires possession of a bicycle to apply for a transfer of the license to the transferee's own name within ten days of the date of such sale or disposition.

Sec. 90-744. - Destroyed, lost or stolen license indicia.

No person shall tamper with, remove, destroy, mutilate or alter any bicycle license or license renewal indicia or registration form or certificate or remove, alter or mutilate the serial number or the identifying marks of the licensing agent's identifying symbol on any bicycle or bicycle frame licensed under this division except as otherwise provided by law. If any license or license renewal indicia or registration certificate or form issued pursuant to this division is lost, stolen or mutilated, the licensee of the bicycle shall immediately notify the licensing agency to obtain a duplicate license or license renewal indicia or registration certificate or form. The licensing agency shall, upon receipt of payment of the appropriate fee, thereupon issue to the licensee a replacement indicia or registration certificate or form.

Sec. 90-745. - Change of address.

Whenever the owner of a bicycle licensed pursuant to this division changes his address, that person shall, within ten days, notify the licensing agency in writing of both the old and the new address.

Sec. 90-746. - License renewal.

Each new license indicia or license renewal indicia issued pursuant to this division shall be renewed on January 1 of the third year following the year of registration. Renewal of a bicycle license shall be indicated by the presence of a supplementary adhesive device affixed by a duly authorized agent of the licensing agency to the bicycle or bicycle frame on or near the indicia already appearing on the bicycle or bicycle frame.

Sec. 90-747. - Applicability to rental agencies.

A rental agency operating within the city shall not rent or offer any bicycle for rent unless the bicycle is licensed as provided in this division.

Sec. 90-748. - Compliance with state law.

In addition to all other requirements of licensing and registration set forth in this division, each bicycle retailer, dealer or purchaser shall comply with the requirements and provisions of Vehicle Code division 16.7.
