2.46.310 - Mediation.

A. Whenever a landlord proposes to increase rent in an amount subject to review under this chapter, or more frequently than permitted under this chapter, the landlord and the homeowners and tenants involved may use informal mediation as a way of reaching agreement on the proposed rent increase without resorting to the formalities, expense and adversary atmosphere of the hearing process provided in this chapter. The city encourages use of mediation as an alternative to the hearing process.

B. At any time prior to filing a petition for a hearing under this chapter, the landlord and the homeowners and tenants affected by the proposed rent increase may file a written request for mediation with the city manager. The written request must be signed by all involved.

C. Upon receipt of a written request for mediation, the city manager shall work with the landlord, homeowners and tenants to select a mediator, if requested. The city manager shall have no other involvement in the mediation other than to help in selecting the mediator and answering questions or providing information to the mediator at the request of the mediator.

D. A written request for mediation under this section shall be deemed agreement by all requesting mediation:

  1. To meet in mediation at least one time within thirty days of the date the mediator is retained;

  2. That all discussion in or connected with the mediation be confidential; and

  3. That the mediation continue only with the agreement of all those requesting mediation and the mediator.

E. The landlord, homeowners and tenants shall notify the city manager in writing of the conclusion of the mediation and of the rent increase, if any, agreed upon by the participants in the mediation.

F. The cost of mediation shall be the full and sole responsibility of those requesting mediation and shall not be an obligation of the city.

G. Any rent increase agreed upon by the participants in a mediation shall be exempt from review under this chapter.
