2.46.300 - Appointment of designated representative.¶
A. An owner, a homeowner, a tenant or a group of homeowners and/or tenants may appoint one or more persons as a designated representative to represent the interests of, negotiate on behalf of, and bind the appointing party.
B. The appointment shall be in writing, shall be dated, shall list the name of the appointing party and the name and address of the designated representative, and shall describe the matters within the scope of this chapter for which the designated representative is authorized to act.
C. The appointment may include the term during which the appointment is valid. If no term is specified, the appointment shall be deemed effective until revoked.
D. Owner's appointment shall be effective upon notifying the city manager of the appointment by mailing or personally delivering a copy of the designation to him or her and posting a copy in a centralized location in the mobile home park for no less than ten days. A homeowner's or tenant's appointment shall be effective upon notifying the city manager and the owner of the mobile home park by mailing or personally delivering a copy of the designation to each.
E. An appointment may be revoked at any time by the appointing party. A revocation shall be in writing and shall be effective upon notifying the city manager and, in the case of an owner's appointment, the homeowners and tenants in the park, or, in the case of a homeowner's or tenant's appointment, the mobile home park owner, in the same manner as notifying of an appointment.
F. A designated representative shall be deemed to be, and to act on behalf of, the appointing party for all purposes under this chapter, subject to any restrictions contained in the appointment.
