2.46.750 - Rent review commission.

A. There is created within the city a mobile home rent review commission, consisting of five members, the membership of which shall be appointed by the city council from a list of applicants to serve at the council's pleasure.

B. Each member shall be a full-time resident within the city.

Commissioners shall serve for terms of four years and until their successors are appointed. Those commission members whose term would have expired on December 31, 1994, shall continue in office until December 31, 1996. Those members whose term would have expired on December 31, 1995, shall continue in office until December 31, 1998, and until their successors are appointed.

  1. A member chosen to fill a vacancy created other than by expiration of a term shall be appointed for the unexpired term of the member whom he or she is to succeed. A member of the commission shall be eligible for reappointment. A vacancy in the commission shall not impair the rights of the remaining members to exercise the powers of the commission. Three members shall constitute a quorum. Three affirmative votes are required for a ruling or decision.

D. The city council shall appoint, for a four-year term, an alternate commissioner in the same manner provided by this section. The alternate commissioner shall serve as a commissioner in the event that a regular member is unable to attend or participate because of absence or conflict of interest. In the event a regular member submits to the city manager a written notice stating that the member will be unable to attend a specific meeting or participate in specific issues because of an absence or conflict of interest, the city manager shall immediately request the alternate to serve in that member's place. The alternate, when sitting as a commission member, shall have the same powers as a regular commission member.

E. Commission members who are tenants, owners or employees of a mobile home park, or who are related in the first degree by blood or marriage to a tenant, owner or employee of a mobile home park, shall not act upon or participate in any decision which will affect the rents in such mobile home park.

2.46.760 - Duties and powers of the commission.

Within the limitations provided by law, the commission shall have the following duties and powers:

A. To meet one time a year or more often if requested by the chair or the city manager. The commission may utilize the city staff and offices and/or facilities as needed;

B. To select a chair and vice-chair for a term of one year;

C. To appoint administrative hearing officers under Section 2.46.510.
