2.46.360 - Base rent—Presumption.¶
A. Except as provided in subsection B of this section, "base rent" means the rent charged by a landlord on January 1, 1988, plus any rent increase authorized by or allowed under this chapter, including rent increases exempt from review under this chapter, but excluding assessments for capital improvements and/or rehabilitation.
B. For rental units which were exempt from the provisions of this chapter by reason of a rental agreement as of January 1, 1988 and which become subject to the provisions of this chapter because of the expiration or other termination of the rental agreement, "base rent" shall mean the average rent received by the landlord for the rental unit during the last thirty days of the rental agreement.
C. For purposes of determining rent increases under this chapter, the base rent, plus any approved assessments for capital improvements or rehabilitation, shall be presumed sufficient to cover operation and maintenance costs, rehabilitation costs and capital improvement costs while also providing the landlord a fair and reasonable return.

2.46.370 - Base rent—Presumption—Rebuttal.¶
Any landlord who disputes the presumption that the base rent, plus approved assessments for capital improvements or rehabilitation, is sufficient to cover operation and maintenance costs, rehabilitation costs, and capital improvement costs, and still provide the landlord a fair and reasonable return, may challenge the presumption by filing a petition for rent increase for a fair market rent adjustment under Section 2.46.490.
