2.04.010 - Office created.

There is created and established the office of administrative officer of the city of Rialto.

2.04.020 - Appointment.

The city council appoints an officer selected solely on the basis of his/her administrative and executive ability and qualifications, who shall be called "city manager," and who holds office at and during the pleasure of the city council.

2.04.030 - Ineligibility of councilmembers.

No person elected or appointed as a city councilmember or mayor is eligible for appointment as city administrator until one year has elapsed after such a member has ceased to be a member of the city council.

2.04.040 - Absence or disability.

In the event the city council determines that the city administrator is unable to perform the duties of his/her office due to absence or disability, the city council or the city administrator with city council concurrence, may designate some duly qualified person to perform the duties of the office during the period of absence or disability of the city administrator, subject, however, to the appointee furnishing a corporate surety bond in the same penal sum as required of the city administrator.

2.04.050 - Term of office—Removal.

A. When the city council appoints the city manager for an indefinite term, it may remove him/her by a majority vote of the council. The city council, in removing the city manager, shall use its discretion and its action is final. The city council may suspend the city manager from duty, but shall, in any case, cause to be paid to him/her forthwith any unpaid balance of his/her salary for services rendered until termination and any other financial obligation arising out of any employment contract, unless relieved by any valid legal defenses.

B. When the city council contracts with the city manager for a term certain, it may remove him/her by a majority vote of the council, but any financial obligations arising out of said contract must be met unless relieved by any valid legal defenses.

2.04.060 - Reimbursement for expenses.

The city administrator is reimbursed for all sums necessarily incurred or paid by him/her in the performance of his/her duties or incurred when traveling on business pertaining to the city under direction of the city council. Reimbursement is only made, however, when a verified, itemized claim, setting forth the sums expended for such business for which reimbursement is requested has been presented to the city council for approval and has been so approved.

2.04.070 - Administrative head.

The city administrator is the administrative head of the government of the city under the direction and control of the city council. He/she is responsible for the efficient administration of all the affairs of the city which are under his/her control. He/she provides leadership for civic movements to benefit the residents of the city when so authorized by the city council. In addition to his/her general powers as administrative head, and not as a limitation thereon, it is his/her duty and he/she has the powers set forth in Sections 2.04.080 through 2.04.270.

2.04.080 - Law enforcement authority.

It is the duty of the city administrator and he/she has the power under the supervision and control of the city council to see that all city laws and ordinances are duly enforced, and that all franchises, permits, licenses and privileges granted by the city are faithfully performed and observed.

2.04.090 - Personnel control.

It is the duty of the city manager and he/she has the power to control, order and give directions to all heads of departments, subordinate officers and employees of the city, except the city clerk, city treasurer, city attorney, and public relations officer; to transfer employees from one department to another; to consolidate or combine offices, positions, departments or units under his/her direction. Except as specifically reserved or prohibited by state law, the city manager shall also have the power to control, order and give directions to any respective staff of the city clerk, city treasurer, and public relations officer.

2.04.100 - Appointment powers.

It is the duty of the city manager and he/she has the power to appoint, promote, demote, and remove any city officers and employees, except the city clerk, city treasurer, city attorney, and any other officer or employee whose appointment, promotion, demotion, and removal is expressly reserved to the city council, subject to all applicable personnel ordinances, rules, and regulations. Except as specifically reserved or prohibited by state law, the city manager shall also have the power to appoint, promote, demote, and remove any respective staff of the city clerk, and city treasurer, subject to all applicable personnel ordinances, rules, and regulations.

2.04.110 - Attendance at council meetings.

It is the duty of the city administrator and he/she has the power to attend all meetings of the city council unless excused therefrom by the council, except when his/her removal is under consideration by the council.

2.04.120 - Recommendation of legislation.

It is the duty of the city administrator and he/she has the power to recommend to the city council for adoption of such measures and ordinances as he/she deems necessary or expedient.

2.04.130 - Advice regarding financial needs of city.

It is the duty of the city administrator and he/she has the power to keep the city council at all times fully advised as to the financial conditions and needs of the city.

2.04.140 - Preparation of annual budget and salary plan.

It is the duty of the city administrator and he/she has the power to prepare and submit the proposed annual budget and the proposed annual salary plan to the city council for its approval.

2.04.150 - Supply purchasing.

It is the duty of the city administrator and he/she has the power to purchase within the framework of the budget, all supplies for all departments or divisions of the city. No expenditure shall be submitted to the city council except on report of the city administrator. Attempts to influence purchase of supplies or equipment by any member of the council are prohibited.

2.04.160 - Investigative powers—Generally.

It is the duty of the city administrator and he/she has the power to make investigations into the affairs of the city and any department or division thereof.

2.04.170 - Investigative powers—Complaints.

It is the duty of the city administrator and he/she has the power to investigate all complaints in relation to matters concerning the administration of the city government and in regard to the service maintained by public utilities in the city.

2.04.180 - Supervision of public property.

It is the duty of the city administrator and he/she has the power to exercise general supervision over all public buildings, public parks, and all other public property which are under the control and jurisdiction of the city council.

2.04.190 - Duty to be full time.

It is the duty of the city administrator and he/she has the power to devote his/her entire time to the duties of his/her office in the interests of the city.

2.04.200 - Maintenance of city property inventory.

It is the duty of the city administrator and he/she has the power to make and keep up to date, an inventory of all property, real and personal, owned by the city, and to recommend to the city council the purchase of new machinery, equipment and supplies whenever in his/her judgment the same can be obtained at the best advantage, taking into consideration trade-in value of machinery, equipment, etc. in use.

2.04.210 - Receiving council mail.

It is the duty of the city administrator and he/she has the power to receive and open all mail addressed to the city council and give immediate attention thereto to the end that all administrative business referred to in the communications and not necessarily requiring city council action, may be disposed of between council meetings; provided that all actions taken pursuant to such communications are reported to the city council at its next regular meeting thereafter.

2.04.220 - Attendance at commission meetings.

The city administrator may attend any and all meetings of the planning commission, recreation, parks and social services commission, mobile home rent review commission, public utilities commission, and any other commissions or boards heretofore or hereafter created by the city council upon his/her own volition or upon direction of the city council. At any such meetings the city administrator attends, he/she shall be heard by such commissions and boards as to all matters upon which he/she wishes to address them.

2.04.230 - Political activity prohibited.

The city administrator is prohibited from engaging in political activities, either contributing or soliciting funds or support for any elective Rialto municipal officials or candidates.

2.04.240 - Cooperation of other city officers.

It is the duty of all subordinate officers, as well as the city clerk, city treasurer and the city attorney, to cooperate with and assist the city manager in administering the affairs of the city most efficiently, economically and harmoniously so far as may be consistent with their duties as prescribed by city law and ordinances.

2.04.250 - Full administrative authority.

The city council and its members shall deal with the administrative services of the city only through the city administrator, except for the purpose of inquiry and information and neither the city council nor any member thereof shall give orders to any subordinates of the city administrator. Neither the city council nor any member thereof shall demand the appointment or removal of any person by the city administrator.

2.04.260 - No legislative power.

There is retained to the city council the sole power of being the policy making and legislative body of the city and the duties and powers of the city administrator are expressly confined to the administrative services of the city under ordinances, resolutions or motion of the council, or under state law.

2.04.270 - Additional duties as delegated.

It is the duty of the city administrator and he/she has the power to perform such other duties and exercise such other powers as may be delegated to him/her from time to time by ordinance or resolution or other action of the city council.
