2.38.010 - Creation.¶
There is created and established a city planning and development department which is designated as the development services department, and includes the planning division, building division and engineering division.

2.38.020 - General supervision.¶
The development services department is a department within the framework of the city's administrative organization and is governed by state and federal laws pertaining thereto, and by the ordinances, policies and procedures established by the city council.

2.38.030 - Director.¶
There is a director of the development services department who is, subject to the general supervision of the city administrator, and with the approval of the city council, solely responsible for the management and conduct of the department. The development services director attends all planning commission meetings and prepares all material requiring their action.

2.38.040 - Function.¶
The function of the development services department is to administer Title 18. Provisions of Title 18 pertaining to the erection, construction, reconstruction, moving, conversion, alteration of, or addition to, any building, or any other construction within the city, whether on public or private property, are enforced by the chief building official under the direction and control of the director of development services who directs the chief building official with regard to Title 18 requirements and the Uniform Building Code.
All city departments, officials and public employees, vested with the duty or authority to issue permits or licenses, shall conform to the provisions of Title 18 and issue no permit or license for uses, buildings, construction or purposes in conflict with the provisions of Title 18, and any such permit or license issued in conflict with the provisions of Title 18 is null and void.

2.38.060 - Building division.¶
There is created and established a city building division under the department of development services. The building division is a unit within the framework of the city's administrative organization and is governed by state and federal laws pertaining thereto, and the ordinances, policies, and procedures established by the city council. The function of the building division is to administer this chapter and Title 15.

2.38.070 - Planning division.¶
There is created and established a city planning division under the department of development services. The planning division is a unit within the framework of the city's administrative organization and is governed by state and federal laws pertaining thereto, and the ordinances, policies, and procedures established by the city council. The function of the planning division is to administer this chapter and Titles 17 and 18 of this code.

2.38.080 - Chief building official.¶
The chief building official of the building division is the official building inspector of the city, and he/she is known as building chief, and is under the control and supervision of the director of development services department.

2.38.110 - Effective dates.¶
Whenever a reference is made in Title 18 to the effective date of a title, chapter or section, the date referred to is the date established by the ordinance from which the title, chapter or section is derived, and not the date of adoption of this code.
