13.16.010 - Permit—Required.¶
No person shall construct any sidewalk, curb, gutter or crosswalk, or do any grading, macadamizing, paving or other work in or on any public place within the city or commence any such work without first obtaining a permit to do so from the superintendent of streets.

13.16.020 - Permit—Application.¶
Any person desiring to obtain a permit as required by Section 13.16.010 shall make written application therefor to the superintendent of streets on a printed form to be supplied by the superintendent of streets, and shall state therein the place where the improvement is to be made or work done, the nature and extent of the work or improvement, the time within which it shall be commenced and when it shall be completed, and that the permit is asked for and the work or improvement therein described will be done subject to the terms and provisions of this chapter.

13.16.030 - Permit—Transferability.¶
Every permit required by this chapter shall be applied for by or in behalf of the person who is actually to perform the work for which the permit is asked. No permit issued under the terms of this chapter shall be transferable or assignable, except by first obtaining a permit to transfer or assign from the superintendent of streets. No person shall do any work under a permit granted to another person unless the permit has first been properly transferred or assigned in accordance with this chapter.

13.16.040 - Permit—Additional requirements and refusal authority.¶
The superintendent of streets or the city manager or the council, on appeal, may in all cases attach such further conditions to the granting of any permit under this chapter as may, in their judgment, seem necessary to secure the proper performance of the work or to protect the public interest in connection therewith, and may determine whether the class of work which the applicant desires to perform is such as should be installed at the place proposed. The city, through its respective officers, expressly reserves the right and privilege to refuse to grant a permit applied for under this chapter whenever, in the judgment of such officers, it is for the best interests of the public to do so.

13.16.050 - Performance standards.¶
All work regulated by this chapter must, in all cases, be done under the direction and to the satisfaction of the superintendent of streets within the time specified in the application required by Section 13.16.020, and in accordance with the city's specifications and regulations for work of that class, and on lines and grades to be given by the superintendent of streets. No person shall do any work regulated by this chapter without first obtaining the lines and grades therefor from the superintendent of streets; nor shall he perform the work other than at the places and on the lines and grades given therefor by the superintendent of streets.

13.16.060 - General regulations and specifications.¶
A. All street, sidewalk, curb and gutter construction regulated by this chapter shall be performed in accordance with general regulations, standards and specifications established by the city council by resolution.
B. Copies of general regulations, standards and specifications, so established shall be maintained on file in the office of the director of transportation and engineering and shall be furnished upon request therefor. All permits issued pursuant to this chapter shall have attached thereto a copy of this chapter so as to inform the permittee of all the requirements contained in this chapter.
C. The city council may amend or change the regulations and standards from time to time hereafter by resolution.

13.16.070 - Inspection and approval.¶
Upon completion of the work to be done under any permit granted pursuant to this chapter, it shall be the duty of the superintendent of streets to make a final inspection thereof, and if it is found to be in accordance with the specifications and regulations for the work and in compliance with the terms of this chapter and on line and grade, he shall issue a final certificate, in duplicate, of acceptance thereof, one of which certificates shall be delivered to the holder of the permit, and the other placed on file in the office of the superintendent of streets.

13.16.080 - Appeal.¶
Any person feeling aggrieved by any action of the superintendent of streets or the city manager in granting or refusing a permit as provided by this chapter, or taking any other action under the terms of this chapter, may, within ten days thereafter, appeal to the council therefrom. The council shall thereupon hold a hearing of the matter and its decisions shall be conclusive.

13.16.090 - Failure to perform work properly.¶
If the work regulated by this chapter does not, in the judgment of the superintendent of streets, comply with the provisions of the permit issued therefor, the superintendent of streets shall notify the person to whom the permit was granted of the defect or failure of performance of the work, and shall require the person within five days of the service of the notice, to proceed to remedy the defect. Service of the notice shall be in writing mailed to the address shown on the application for permit. Nothing in this section shall prevent the superintendent of streets, or other city officials, from taking any appropriate action to prevent a violation of this chapter or to punish a violator thereof.
