13.04.010 - Acquisition by city.¶
All streets, avenues, alleys, waterfronts, parks and plazas within the city which are laid down, marked, or designated as such upon any survey, map or plat of any subdivision of the city, town, or city or town addition, or any subdivision thereof, recorded or on file in the office of the county recorder, or county surveyor, or which have been legally established as such by the board of supervisors of the county or the city council or which have in any way been dedicated to the use of the public by the owner of the soil and used by the public, or to which the public has acquired a right by prescription or otherwise, and which have not been vacated by the board of supervisors of the county or the city council are declared to be established as public streets, avenues, alleys, levees, waterfronts, parks and plazas; provided, however, that acquisition by the city of rights in such property by any of the means named in this section shall not thereby impose any duty on the city to improve such property.

13.04.020 - Acceptance.¶
Whenever any street or portion of a street, which has not heretofore been accepted, has been, or shall hereafter be, fully constructed to the satisfaction of the superintendent of streets and the city council, in accordance with the provisions of this code, and is in a good condition throughout, and a sewer, gas pipes and water pipes are laid therein, under such regulations as the city council may adopt, it shall be accepted by the city council, and thereafter shall be kept in repair and improved by the city, and the expense thereof shall be paid out of a fund to be provided by the city council for that purpose; provided, that the city council shall not accept any portion of the street less than the entire width of the roadway, including the curbing, and one block in length, or one entire crossing; and, provided further, that the city council may partially or conditionally accept any street, or portion of a street, without a sewer or gas pipes or water pipes therein, providing in the ordinance of partial or conditional acceptance that the city council declares that it deems the sewer or gas pipes or water pipes to be then unnecessary.

13.04.030 - Abandonment requirements.¶
Any person desiring the abandonment of a street or alley, or portion thereof, shall apply to the city council requesting such abandonment. The application shall be accompanied by a fee of twenty-five dollars to cover the administrative costs of processing the abandonment and shall also be accompanied by a preliminary title report obtained by the applicant from a title insurance and trust company, setting forth the present state of the title of the street or alley or portion of it requested by the applicant to be abandoned. The city council shall not abandon any street or alley or portion thereof upon such application, unless it appears that it is not in the public interest to continue the establishment and maintenance of the street or alley or portion thereof, and if it is determined to vacate or abandon it, the city council may retain over, under, or across the portion to be abandoned such utility easements as are deemed to be in the public interest.
