Chapter 2.375 — EMERGENCY AUXILIARY FORCES

2.375.010 - Establishment.

This chapter establishes 3 volunteer organizations collectively designated as "emergency auxiliary forces." The "emergency auxiliary forces" are composed of the "auxiliary fire force," separate and distinct from the fire department of the city; the "reserve police force," separate and distinct from the police department of the city; and the "emergency medical volunteer reserve unit," separate and distinct from the fire department of the city. The maximum number of persons allowed to serve in each of these volunteer organizations shall be set by resolution of the council.

2.375.020 - Management.

A.

City Manager. Subject to the authority of the city manager, the emergency auxiliary forces shall be under the control and direction of the chiefs of the respective fire and police departments.

B.

Chiefs. The fire chief shall direct, supervise and control the auxiliary fire force and the emergency medical volunteer reserve unit. The police chief shall direct, supervise and control the reserve police force. Each chief shall maintain a roster of his/her auxiliary or reserve force, duplicates of which shall be maintained in the office of disaster preparedness of the city and in the office of risk and grants management.

2.375.030 - Training and appointment.

Subject to the approval of the city manager, each chief may appoint as members of his/her auxiliary or reserve force any person he/she deems qualified and may reject any applicant. Each chief shall provide necessary training programs for applicants and for members.

2.375.040 - Oath.

No person shall be a member of an emergency auxiliary force until he/she has taken an oath or affirmation that he/she will carry out the duties prescribed in this chapter and as prescribed by Article XX, Section 3 of the Constitution of California, which oath shall be administered and filed in accordance with the requirements of this code.

2.375.050 - Resignation and separation.

Any member of these forces may resign at any time by notifying his/her chief thereof. The chief may separate any member of his/her force at any time for any reason, and may, subject to approval of the city manager, expand or reduce the membership of his/her force within limits established by resolution of the council.

2.375.060 - Identification of members.

An identification card, insignia or evidence of identity, as may be prescribed by the fire and police chiefs, shall be issued to each member by his/her chief, which the member must carry at all times while on duty. Such card, insignia or other identification shall remain the property of the city and shall be surrendered to the chief at the time the member resigns or is otherwise separated from the force.

2.375.070 - Auxiliary fire force—Duties.

The duties of a member of the auxiliary fire force shall be to assist the regular members of the fire department of the city in preventing, controlling and extinguishing fires, to aid in the functions of disaster preparedness, and to perform such related duties as the chief by order may prescribe. The chief may prescribe duties other than those mentioned herein to be performed by a member of the auxiliary fire force consistent with the provisions hereof, and subject to approval by the city manager.

2.375.080 - Reserve police force—Duties.

The duties of a member of the reserve police force, shall be to assist the regular members of the police department of the city in the prevention of crime, the enforcement of law and maintenance of peace and order, and the provision of civil defense assistance during national disasters or disasters caused by enemy action. The police chief by order may fix the specific duties of the members of the force and provide for the maintenance of discipline. The police chief may change such orders from time to time and he/she may command members of the force to obey the instructions of regular police officers and reserve officers in carrying out their duties. The chief may prescribe other duties than those mentioned herein to be performed by a member of the reserve police force consistent with the provisions hereof and subject to the approval of the city manager. A member of the reserve police force shall at all times have the full powers and duties of a peace officer as provided by Penal Code Section 830.1, provided such person qualifies as set forth in Penal Code Section 830.6(a)(2) or Section 832.6(b).

2.375.090 - Emergency medical volunteer reserve unit—Duties.

The duties of a member of the emergency medical volunteer reserve unit shall be to assist the regular members of the fire department of the city in emergency ambulance operations, emergency patient care, provide aid in the functions of disaster preparedness and such other emergency services as may be deemed necessary or appropriate by the fire chief.

The fire chief may prescribe duties other than those mentioned herein to be performed by a member of the emergency medical volunteer reserve unit consistent with the provisions hereof and subject to the approval of the city manager.

2.375.095 - Carrying of weapons.

No member of any of the emergency auxiliary forces not qualifying for peace officer status under Penal Code Section 830.6 or Section 832.6 shall carry or use any firearm or other weapon while on duty, except upon the express written order of the police chief.

2.375.100 - Summary dismissal and publication.

In addition to the penalties provided by law, any violation of law under color of the performance of his/her duties as a member of any emergency auxiliary force and any breach of the rules and regulations established by the city manager, or the fire or police chief shall subject any member to summary expulsion, and the fact thereof may be published at the order of the chief. This provision shall not be deemed a limitation upon the chief's authority to dismiss any person from membership in any of the emergency auxiliary forces.

2.375.110 - False personation.

A person shall not wear, carry or display any identification card or insignia or facsimile thereof, or otherwise to represent himself/herself to be a member of any of the emergency auxiliary forces of the city unless the acts, card or badge are specifically authorized by the provisions of this chapter.

2.375.120 - False identification.

A.

No person shall retain an identification card, insignia or other evidence of identity issued to a member of any of the emergency auxiliary forces of the city unless the acts, card or badge are specifically authorized by the provisions of this chapter.

B.

No person shall make, prepare, print, issue, use or possess any card intended as, appearing to be, or purporting to be a card of identification, or any badge of a member of any of the emergency auxiliary forces of the city, unless the acts, card or badge are specifically authorized by the provisions of this chapter.
