Chapter 12.28 — IMPROVEMENT ASSESSMENTS

This chapter shall be designated "improvement ordinance of 1924" and a reference thereto by such designation shall be sufficient for all purposes.

All streets, lanes, alleys, places or courts in the city as they now exist or may hereafter exist, now open or dedicated, or which may hereafter be opened or dedicated to public use, shall be deemed and held to be open public streets, lanes, alleys, places or courts for the purpose of this chapter.

The word "improvement" as used herein means and includes all work mentioned in subdivisions (a) to (k) inclusive of Section 2 of the "Improvement Act of 1911" of the state of California and amendments thereto, and also the following work:

"(l) Ditches, pipes and conduits for wires for street lighting, police and fire signaling and communication of similar nature, and for the transmission or distribution of electrical energy for domestic, commercial and power purposes.

(m) All other work which may be deemed necessary to improve the whole or any portion of such streets, avenues, lanes, alleys, courts, places, public ways or property or rights-of-way owned by the City.

(n) All other work auxiliary to any of the above which may be required to carry out the same."

Whenever in the opinion of the board of directors of the city the public interest or convenience may require, the board of directors may, under the provisions of this chapter and in the manner and with the effect herein provided, order the whole or any portion or portions either in length or width of any 1 or more of the streets, avenues, lanes, alleys, courts, places, public ways of the city, or property, or rights-of-way owned by the city, to be improved or to have constructed therein either singly or in any combination thereof, any improvement as above defined.

All parts, sections and provisions of the Street Improvement Act of 1911, except the provisions of Sections 1 and 2 thereof, are hereby adopted and referred to and made part of this chapter with the same force and effect as though specifically set forth herein, and all proceedings taken hereunder shall conform in all respects to the procedure fixed and established by the said Act as now or hereafter amended; provided, however, that wherever in said Act, the form of any document, instrument or bond is fixed, such form shall be deemed to be amended and modified hereby to the extent necessary to adapt such form to the proceedings taken hereunder, and to contain reference to this chapter in all instances in which language of such form as fixed by said Act refers to said Act; and provided further that the resolution of intention for all proceedings taken hereunder shall contain a statement that the board of directors elects to proceed under the provisions of this chapter.

The per diem wages to be paid to laborers, workmen and/or mechanics employed in the execution of any contract awarded under proceedings taken under this chapter shall be determined by private agreement between the contractor or subcontractor and such laborers, workmen and/or mechanics and not otherwise.
