Chapter 2.365 — CLAIMS BY AND AGAINST THE CITY

2.365.010 - Signed by officers.¶
Except as otherwise provided herein, all demands payable out of the treasury must, prior to payment thereof, be signed by the director of finance and the city treasurer, as herein provided.

2.365.020 - Verification and accuracy.¶
All demands on the treasury of the city shall be duly verified by the individual making the demand and shall be presented to the director of finance who shall cause the same to be examined and verified as to validity and accuracy.

2.365.030 - Issuance and validation of warrants.¶
A.
The director of finance shall be authorized to issue the check or warrant of the city for the amount of the demand; provided, however, that such warrant shall not be valid until signed by the city treasurer.
B.
Upon authorization by the city attorney, the director of finance shall be authorized to issue the warrant or check of the city for the amount authorized as settlement/compromise of claims for damages against the city in civil actions and proceedings. Authorization by the city council is necessary where a settlement/compromise exceeds the authority granted to the city attorney. Such warrant or check shall not be valid until signed by the city treasurer.

2.365.040 - Not applicable to bonded indebtedness.¶
Nothing herein shall be construed as interfering with or preventing the payment by the city treasurer of the principal and interest on bonds or certificates of participation or other financial instruments issued by the city and the interest coupons thereon, in accordance with the constitution, laws and ordinances authorizing the issuance of bonds such indebtedness.

2.365.050 - City claims up to 2500 dollars.¶
The director of finance is authorized and directed to execute on behalf of the city all releases up to the sum of $2,500.00 in satisfaction of claims of the city where payment in full is tendered, or to execute such releases conditioned upon the payment in full of the city's damages.

2.365.060 - No compromise of claims for city damages.¶
Nothing herein contained shall authorize the director of finance to compromise or settle any claim and/or demand of the city except for the total amount of the city's damages without the consent of the city manager.

2.365.070 - City claims over 2500 dollars.¶
The city manager is authorized and directed to execute such releases in excess of $2,500.00. Nothing herein contained shall authorize the city manager to compromise or settle any claim by the city except for the total amount of the city's damages.

2.365.080 - Claims against the city; delegation of claims functions to risk and insurance administrator.¶
Claims and actions for money or damages against the City of Pasadena or its employees are governed by the provisions of Chapter 1 of Division 3.6 of the Government Code commencing with Section 900 and following.
All claims or demands against the city shall conform to the requirements of Part 3 of Division 3.6 of Title 1 of the Government Code, or of a form provided by the city clerk. The procedures for presentation, consideration and action upon all claims filed pursuant to this section shall be the same procedures provided by Chapter 1 and Chapter 2 of Division 3.6 of the Government Code.
Pursuant to Government Code Section 935.4, the city risk and insurance administrator is authorized and directed to act on claims presented to the city by investigating such claims, and sending out all appropriate notices, including late claim rejections and denial notices. If the city council is provided with a list of recently-presented claims, such provision is for information only, in view of this delegation. The city risk and insurance administrator is authorized to allow, compromise or settle claims in a sum not to exceed $5,000.00.
