Chapter 10.53 — LOCAL INTERSTATE TRUCK ROUTES

10.53.010 - Definitions.¶
The following words are defined as follows:
A.
"Terminal" means a facility at which freight is consolidated to be shipped and where full load consignments may be offloaded, or at which interstate trucks are regularly maintained, stored or manufactured.
B.
"Interstate truck" includes any commercial tractor/trailer combination denied local access by state or federal law in the absence of enabling local legislation.

10.53.020 - Purpose.¶
The purpose of this chapter is to establish procedures for designating interstate truck terminals and local terminal connection routes upon which interstate trucks may travel to and from the federally designated highway system, and to thus promote the public health, safety and welfare.

10.53.030 - Application and determination.¶
A.
Any person seeking terminal and route designation under this chapter shall submit an application to the public works department on a city-approved form.
B.
Upon receipt of the application, the traffic and transportation engineer will conduct an investigation to ascertain whether or not the proposed terminal facility meets the requirements for an interstate truck terminal. Once a terminal is approved, the traffic and transportation engineer will then determine the capability of the route requested and alternate routes, whether requested or not. Determination of route capability will include, without limitation, a review of adequate turning radii and lane
widths of ramps, intersections and highways and general traffic conditions such as sight distance, speed and traffic volumes. No access route from a federally designated highway system will be approved without the approval of the California Department of Transportation.
C.
The traffic and transportation engineer is authorized to designate the interstate truck terminals and their connecting local truck routes, and to revoke or withdraw such designations.

10.53.040 - Fees.¶
A.
The applicant shall pay a nonrefundable application fee, as established by the traffic and transportation engineer.
B.
Upon the approval of a designated terminal and connecting route by the city and the California Department of Transportation, the applicant shall deposit with the city sufficient funds, as estimated by the traffic and transportation engineer, to pay for the purchase and installation of terminal trailblazer signs. Trailblazer signs will be required at every decision point in the city on route to and from the terminal and the designated state highway. Any difference between the actual and the estimated cost shall be billed or refunded to the applicant. No terminal or route may be used until such signs are in place.

10.53.050 - Retrofitting.¶
A.
If all feasible routes to the requested terminal are found to be unsatisfactory by the traffic and transportation engineer, the applicant may request permission to retrofit the deficiencies. All costs of engineering, construction and inspection will be the sole responsibility of the applicant. Except when the retrofitting of deficiencies is within the jurisdiction of the California Department of Transportation, the actual construction will be done by the city or by a contractor approved in writing by the city.
B.
The applicant shall deposit the estimated cost of retrofitting, as determined by the traffic and transportation engineer, with the city. Any difference between the actual and the estimated cost shall be billed or refunded to the applicant.
C.
Should, at any time within 5 years from the date of completion of the retrofitting, another applicant seek terminal approval on a route which has already been retrofitted, such other applicant's fee may include a proportionate share of the earlier retrofitting, as determined by the traffic and transportation engineer. Such proportionate share may be disbursed by the city to the person or persons who paid for the original retrofitting.

10.53.060 - Appeal process.¶
A.
The applicant/terminal owner may, within 10 days of the mailing of the decision of the traffic and transportation engineer, appeal the decision to the city board of directors. The appeal shall be on a form prescribed by the department of public
works, filed with the city clerk, and shall specify the alleged error or abuse of discretion by the traffic and transportation engineer. Within 10 days of the filing of an appeal, the traffic and transportation engineer shall transmit the initial application, all data filed therewith, and the engineer's report, findings and decision to the city clerk, who shall make copies thereof available to the applicant/appellant.
B.
The city clerk shall give notice to interested parties who have requested notice, but no other notice is required.
C.
Any appeal of a denial or revocation by the California Department of Transportation must be made directly to the California Department of Transportation.
