Chapter 10.45 — PARKING METERS

Upon establishment of a parking meter zone by this chapter, the director is authorized to install and maintain parking meters, and to mark parking meter spaces to indicate where authorized parking is permitted.

No vehicle shall be stopped, left standing or parked within a parking meter space other than entirely within a single parking meter space unless the size or shape of the vehicle makes compliance impossible.

Sections 10.45.030, 10.45.040, 10.45.045 and 10.45.050 of this chapter shall not apply to any of the following: vehicles lawfully displaying a special identification license plate or placard issued to a disabled person; vehicles of disabled veterans, emergency vehicles and other vehicles exempted from observing parking regulations pursuant to the applicable provisions of the California Vehicle Code, and vehicles exempted from this title by Section 10.12.050.

The director is authorized to issue no-fee parking placards on a temporary or periodic basis as follows: For city-owned vehicles, for vehicles owned by a person who meets the qualifications for exemption from utility uses tax, qualifying for lifeline utility rates as set forth in Chapter 4.56 and Section 8.60.210 of this code, or any successor provisions, and for vehicles owned by a person who is 60 years of age or older and who can establish that a no-fee parking placard for specific times and a specific place would assist in their access to needed public health, welfare or social services. The director is also authorized to issue no-fee parking placards on a temporary or periodic basis, by need, to city departments for the use of city employees and to the mayor's and city council offices; for the use of those offices. The director shall maintain, annually, a list of no-fee parking placard holders on file with the office of the city clerk. A no-fee parking placard shall not exempt the vehicle displaying said placard from complying with any parking regulation including, but without limitation, the time restrictions on parking in time-limited parking spaces, including in metered parking spaces. No-fee placards are not valid in green, yellow or white zones. The director shall establish administrative procedures for the review and processing of applications for such placards, for the granting and revocation of such placards and for time and place restrictions on the use of any such placard.

The director may take any meter out of service temporarily or permanently by removal, by covering or other means. This shall be based upon the director's finding of public need and necessity, or of public benefit, or of an alternative means of securing all meter revenue on a special event basis and shall be based upon good traffic engineering principles. This may include, but not be limited to, parking meters in spaces then in use for a valet parking operation pursuant to Chapter 12.14.

No person shall park, stand or stop any vehicle in any metered parking space, during a period for which a parking time limit is applicable, without depositing in the parking meter adjacent such lawful money of the United States, or the equivalent thereof as provided for by the parking meter, as required by the parking meter for the duration of time the vehicle occupies the space. For "pay and display" meters, upon proper payment, a receipt will be printed that must be displayed on the vehicle dashboard indicating the length of time the vehicle is authorized to park in a space adjacent to the meter. Deposit of money shall not be required to the extent of any unexpired portion of time remaining on the parking meter for which coins had been previously deposited.

Payments for metered spaces via an authorized mobile payment application will also be considered as satisfying the payment requirements of this section.

The parking, stopping or standing of any vehicle in a metered parking space at which the parking meter displays a flag, signal or sign indicating that the permitted or paid time has expired, or the "pay and display" receipt is properly displayed and indicates that the paid time has expired, or the parking enforcement software utilized by enforcement officers indicates the paid time for the vehicle has expired, or the "pay and display" receipt has not been properly displayed, or the mobile application payment has been determined to have expired shall constitute a prima facie presumption that the vehicle has been parked in violation of this chapter.

A.

The maximum legal parking time for each parking meter space shall be as determined from time to time by the director and shall be indicated by signs adjacent to the parking meter or on the parking meter stand. Such determination shall be based upon good traffic engineering principles, traffic investigation and surveys made from time to time.

The maximum legal parking time shall not be in excess of any maximum legal parking time which may be prescribed and determined and posted as provided elsewhere in this title.

B.

Nothing contained herein shall be deemed or construed to permit parking during times or hours prohibited elsewhere in this title.

Provisions of this chapter which require deposit of coins in or other payment at parking meters shall apply at such times and hours as may be determined from time to time by the director, based upon good engineering principles, traffic investigation and surveys made from time to time. Such times and hours shall be indicated by signs adjacent to the parking meter or on the parking meter stand; provided, however, that the director may, in his or her discretion, from time to time prohibit all parking in any or all parking meter spaces in the parking meter zones during times of emergency or public need or necessity by causing the appropriate "NO PARKING" signs to be posted or for any other reason or in any other manner specified by this title.

No person, by depositing or causing to be deposited any lawful money of the United States, or the equivalent thereof as provided for by the parking meter, shall extend the time for stopping, parking or standing of any vehicle beyond the time permitted by this chapter in the parking zone when the vehicle has occupied the parking meter space for a consecutive number of minutes equal to or in excess of the legal limit for the parking meter space.

No person shall deposit or cause to be deposited in any parking meter any slug, device, or substitute for lawful money of the United States or any other unauthorized payment device, or to otherwise fraudulently attempt to obtain time on a parking meter or otherwise avoid making the required payment.

No person not authorized by the director shall remove, open, tamper with or willfully impair the usefulness of any parking meter installed pursuant to this chapter.

All monies deposited in any parking meter shall be collected regularly by city employees designated by the director, or by one or more contractors selected and approved by the city in a manner consistent with the charter of the city and all applicable ordinances, rules and regulations.

The city council may establish by ordinance or resolution an advisory body from each parking meter zone, which body will be made up of property owners and tenants from within the parking meter zone and which will meet as may be required by the city council in order to recommend to the city council the priority expenditures of net revenues from parking meters in its zone for street and parking related expenditures which regulate and control traffic and parking within the parking meter zone and its surrounding area.

The parking meter rate shall be $.00 for vehicles lawfully displaying a no-fee placard, in a manner consistent with any limitations imposed upon the use of such placard, issued pursuant to Section 10.45.027 of this code.

D.

The parking meter rate shall be $0.75 for each sixty minutes for those parking meters located within the boundary areas of the special West Gateway Parking Meter Zone which is as follows:

B.

Except as provided otherwise by this chapter, an escalating parking meter rate will be in effect and the Director of Transportation shall adjust the base parking meter rate at no less than $1.00 per hour and no greater than $5.00 per hour as permitted by posted parking regulations.

The rates shall be based on parking demand, with the goal of reaching occupancy by vehicles at the rate of 70 to 90 percent for parking meter spaces on each block at such times and hours that payment is required;

Rate changes will not occur more than once every six months;

The Director of Transportation shall set the escalated parking rate to be up to two times the base meter rate for any parking beyond an initial base parking period; and

Beginning on July 1, 2025, and on each July 1, thereafter, the maximum rates shall be raised by an amount equal to the change in the consumer price index and rounded down to the nearest quarter of a dollar.

C.

The parking meter rate shall be $0.00 for vehicles lawfully displaying a no-fee placard, in a manner consistent with any limitations imposed upon the use of such placard, issued pursuant to Section 10.45.027 of this chapter.

The South Lake parking meter zone is described as follows:

Violations of Sections 10.45.020, 10.45.030, 10.45.040, 10.45.045 or 10.45.050 of this chapter shall be subject to civil parking penalties pursuant to the schedule of parking penalties established by the city council.

B.

Any person violating Section 10.45.060 or 10.45.070 of this chapter is guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not more than $1,000.00 or by imprisonment in the county jail for a period of not more than 6 months or by both such fine and imprisonment.
