Chapter 13.12 — UTILITY LOCATION MAPS

13.12.010 - Definitions.

A.

"Utility company," as herein used, means any person, copartnership or corporation engaged in the business of furnishing the inhabitants of the city with water, light, power, heat or telephone or telegraph service.

B.

"Street," as herein used, includes avenues, boulevards, highways, lanes, alleys, crossings, intersections, courts and public ways of the city of Pasadena.

C.

"Works," as herein used, includes any main, service pipe, conduit, duct, tunnel, wire, cable, pole or other structure maintained by any utility company in, along, under or across any street of the city of Pasadena.

13.12.020 - Required—Specifications.

Each utility company maintaining underground works in, along, under or across any street, alley or other public place in the city is required to file with the city engineer within 90 days from the date of the adoption of Ordinance 1337, maps prepared in ink on tracing cloth, or blue or brown line prints, on good grade paper of a quality approved by the city engineer, in sheets not larger than 24 inches by 36 inches. If such sheets are smaller than 24 inches by 36 inches they shall be some aliquot part of a sheet of that size and shall have at least 1 24-inch edge. The scale of such maps shall be 100 feet to 1 inch and they shall show by delineation, letters and figures:

A.

The exact route and location of the works of the utility company filing the same, with reference to street and curb lines;

B.

The depth of such works below the surface of the ground;

C.

The dimensions of the constituent parts of such works and the material of which constructed;

D.

All manholes, valves, gates and other special construction features, and the position and dimensions of each;

E.

The purpose for which such works and each portion thereof are maintained, including a statement of maximum voltage carried in case of electrical works;

F.

The date of the construction, installation or laying of such works. If the exact date is unknown, the approximate date shall be stated.

13.12.030 - Filing deadline.

Every utility company maintaining or operating any overhead electrical works shall within 90 days from the time Ordinance 1337 takes effect, file with the city engineer, charts, blue or brown prints or drawings, on cloth or paper of the size and quality specified for maps in Section 13.12.020, showing all of the styles of standard overhead construction used by such utility company. Such chart, blue or brown print or drawing shall show the height of poles (including portion underground), the proportion thereof underground, the number, length and spacing of crossarms and all other details of construction affecting or which may affect the amount and location of aerial space occupied by construction. Each of the styles of construction shall be designated by a letter or number so that each may be referred to and identified in the description filed pursuant to this section. Within 90 days from the time Ordinance 1337 becomes effective each utility company operating or maintaining any overhead electrical works shall file with the city engineer complete descriptions of its works stating the purpose for which such works are maintained, including a statement of maximum voltage carried, showing the approximate routes of such works by reference to streets and sides of streets, the style of construction used, referring to the chart, blue or brown print or drawing herein required, and all variations from the standard styles of construction shown on the chart, blue or brown line print or drawing, if such variations affect the amount or location of aerial space occupied, in such manner that by inspection of such description and reference to such charts, blue or brown prints or drawings the details of construction and the aerial space occupied in any and all streets, alleys and public places in the city occupied by such works may be ascertained.

13.12.040 - Filing before excavation work.

A.

Each utility company before making or causing to be made any excavation in any street, alley or other public place in the city for the purpose of constructing, installing or laying its works, shall file with the city engineer of the city of Pasadena maps, charts, blue or brown prints, drawings and descriptions, containing the same information with reference to the proposed work as is required in case of existing works by Sections 13.12.020 and 13.12.030 and in addition thereto a statement of the estimated time required for the completion of such proposed works. Maps, charts, blue or brown prints or drawings filed pursuant to the terms of this section shall conform to the requirements of Sections 13.12.020 and 13.12.030 as far as said sections are applicable to new work, provided that in cases of proposed overhead work a map or drawing satisfactory to the city engineer may be filed together with a description conforming to the requirements of Section 13.12.030. If the proposed work does not require excavation but will change the amount or location of space occupied by overhead work, a map thereof satisfactory to the city engineer, and description shall be filed with the city engineer prior to commencement of work and it shall be unlawful to proceed with such work before filing the map and description.

B.

The requirements of this section shall not be deemed to apply when the proposed work consists solely of laying lateral service connections or installing overhead service connections. The required maps, charts, blue or brown prints, drawings and descriptions shall be approved by the city engineer and his approval endorsed thereon in writing.

13.12.050 - Statement of work completion.

Upon completion of any new works (or every 90 days after the commencement of the construction thereof in case the work of construction shall extend beyond the period of 90 days), a statement shall be filed showing what work has been completed. All work now in process of construction shall be deemed existing works for the purposes of this chapter.

13.12.060 - Rights not granted by chapter.

None of the provisions of this chapter and nothing done or permitted pursuant hereto, and no circumstance or inference arising therefrom, shall be held or construed to grant any utility company any right or easement, or any privilege or franchise of any nature in, to, along or under any street of the city.

13.12.070 - Space use determination.

It is the purpose of this chapter to provide an accurate means of determining the amount of space used and required, and to be used and required by all public utilities maintaining works in the streets of the city, and to assist in determination of rights-of-way and the equitable apportionment of space in and above streets to public service corporations. The terms hereof shall be liberally construed to effect these ends.

13.12.080 - Failure to file unlawful.

It is unlawful for any person or corporation, for himself or itself, or for any other person, or for any firm, association or corporation, either as principal, agent, officer, servant or employee, to fail, neglect or refuse to file the maps, statements or information, or any thereof, required by this chapter, or to fail, neglect or refuse to comply with any provision of this chapter.

13.12.090 - Violation—Penalty.

Any person or corporation, whether as principal, agent, officer, clerk or employee, either for himself or itself, or for any other person or corporation, or for any firm or association, who or which shall violate any of the provisions of this chapter, is guilty of a misdemeanor, and upon conviction thereof shall be punished by imprisonment in the city jail not exceeding 6 months, or by a fine not exceeding $500.00, or both such fine and imprisonment. Each day during which a violation of any provision of this chapter continues shall constitute a separate and distinct offense.
