Sec. 5-25.20. - Alternative actions available.

Nothing in this chapter shall be deemed to prevent the City Council from ordering the commencement of alternative civil or criminal proceedings to abate or otherwise address a public nuisance in conjunction with, the proceedings set forth in this chapter.

Sec. 5-25.21. - Violation and penalties.

Violations of this chapter shall be punishable as provided in Section 1-2.01 of this Code, however, any Code Enforcement Officer with citation authority may file or prosecute any violation of this chapter as an infraction punishable under Section 1-2.01(d) of this Code.

Sec. 5-25.22. - Treble costs of abatement.

Upon entry of a second or subsequent civil or criminal judgement within a two-year period finding that an owner of property is responsible for a condition constituting a public nuisance subject to abatement under this Code, except for conditions which are abated pursuant to Section 17980 of the California Health and Safety Code, the court may order the owner to pay treble the costs of abatement, as provided in Government Code Section 38773.7.

Sec. 5-25.23. - Criminal enforcement authority.

(a) The City Council hereby authorizes the City's Code Enforcement Officer to issue criminal citations (notices to appear) for any violations of this chapter of the Pacifica Municipal Code.

(b) This chapter may be enforced by the sworn personnel of the Pacifica Police Department.

(c) The Pacifica City Council may further designate any Pacifica employee with the full or limited authority to issue criminal citations for any violation of this chapter, provided such employee meets the requirements listed in Section 836.5 of the Penal Code and Section 2-7.01 of this Code.
