Sec. 5-5.01. - Purpose.¶
The purpose of this chapter shall be to implement the responsibility of the City to provide for the orderly conduct of public dances.

Sec. 5-5.02. - Public dance defined.¶
For the purposes of this chapter, "public dance" shall mean any dance to which the public is admitted or at which an admission fee is charged for persons attending the dance, whether such admission fee is charged at the door, through the sales of tickets, or in any other manner whatsoever. "Public dance" shall not include:
(a) Any dance held by a business establishment which is licensed by the Alcoholic Beverage Control Board of the State where dancing is incidental to the other activities of such business;
(b) Any dance conducted directly by public schools, or by the recognized student body organizations thereof, when such dance is conducted on school premises; or
(c) Any dance conducted directly by the Park, Beaches, and Recreation Department.

Sec. 5-5.03. - Permits: Required.¶
It shall be unlawful for any person to open, conduct, or carry on, or to participate in the opening, conducting, or carrying on, of any public dance in the City without procuring a permit for such purpose from the Chief of Police. The provisions of this section shall not be construed as prohibiting the issuance of a permit to an organization for periods of up to one year from the date of the issuance of such permit for the conduct of regular dances.

Sec. 5-5.04. - Permits: Applications: Form.¶
Before any permit shall be granted, as provided in Section 5-5.03 of this chapter, an application, together with a fee as specified by Council policy, shall be filed with the Chief of Police not less than two (2) weeks in advance of the date of the dance by the person desiring to conduct such dance, which application shall set forth over the signature of the applicant the following information:
(a) The name and address of the applicant;
(b) The address of the place where the dance shall be held and the date thereof;
(c) The name and address of the person who will be in charge of the dance and will be present during the time the dance is taking place;
(d) The estimated number of persons who will attend the dance;
(e) The hours during which the dance will take place;
(f) A general statement of the type of dance to be conducted; and
(g) Such additional information as the Chief of Police shall require.

Sec. 5-5.05. - Permits: Issuance: Conditions.¶
The Chief of Police shall make all necessary arrangements with the applicant for a permit to conduct a public dance for the presence of the off-duty police officers required at such dance by the provisions of Section 5-5.08 of this chapter prior to the issuance of such permit. The Chief of Police shall impose such conditions and requirements upon the issuance of the permit as he shall deem necessary in order to protect and preserve the safety of the persons attending such dance and the peace and quietude of the neighborhood in which the dance is being conducted.

Sec. 5-5.06. - Permits: Issuance or nonissuance: Appeals.¶
Any person aggrieved by any decision of the Chief of Police with respect to the issuance or nonissuance of a dance permit may make an appeal thereon to the Council.

Sec. 5-5.07. - Permits: Nontransferable.¶
No permit issued pursuant to the provisions of this chapter shall be assignable or transferable.

Sec. 5-5.08. - Police supervision: Costs.¶
The Chief of Police shall determine the number, if any, of off-duty police officers who shall be required to be present during public dances. The costs for the presence of such off-duty police officers shall be paid by the applicant.
