Pacifica Municipal Code Ch. 29 Mandatory Real Estate Transfer Disclosure Regarding Airport Noise

Sec. 5-29.01. - Purpose.

(a) On or after the effective date of the ordinance codified in this chapter, any seller of a single or multifamily residential dwelling located in the City, and any agent representing a seller of such real property, shall be required to make the disclosures set out in this chapter to the prospective purchaser as soon as practicable before transfer of title.

(b) The required disclosures shall be made on a copy of the Local Option, Real Estate Transfer Disclosure Statement Form set out in Civil Code Section 1102.6a.

Sec. 5-29.02. - General disclosure.

For property located in the City, the following information is required to be disclosed in connection with sales of residential dwellings:

(a) At its closest point, the City is located two and one-half (2.5) miles from San Francisco International Airport;

(b) San Francisco International Airport is the fifth largest airport by volume in the United States and the seventh largest by volume in the world;

(c) The property is subject to noise from aircraft overflight.

Sec. 5-29.03. - Special disclosure for property within the CNEL Noise Footprint.

For property located within the aircraft noise footprint based upon the FAA 1983 FAA CNEL Noise Exposure Map set forth following this section, the following disclosures shall be made in connection with sales of residential dwellings:

(a) The subject property is located within the aircraft noise footprint of the FAA 1983 CNEL Noise Exposure Map for Pacifica, California. The property is subject to noise from aircraft overflight;

(b) At its closest point, the 1983 CNEL contour area is four and one-tenth (4.1) miles from San Francisco International Airport;

(c) San Francisco International Airport is the fifth largest airport by volume in the United States and the seventh largest by volume in the world;

(d) After January 1, 1993, if the subject property was constructed or reconstructed after its total or partial destruction, or is reconstructed or renovated in the future at a cost equal to twenty-five (25%) percent or more of the current market value of the home, it must be insulated against aircraft noise to meet FAA noise insulation program standards;

(e) If the subject property has already received noise insulation pursuant to the FAA noise insulation program, the owner may not deliberately or willfully act to reduce or destroy the effectiveness of the noise mitigation measures.
