Sec. 5-11.01. - Loitering.

It shall be unlawful for any minor person under the age of eighteen (18) years to loiter upon or about the public streets, avenues, alleys, parks, squares, or any public places within the City between the hours of 11:00 p.m. and the time of sunrise of the following morning when not accompanied by his parent or legal guardian having the care and custody of such minor person, except where the presence of the minor person in such place is connected with and required by some legitimate business, trade, profession, or occupation in which he is engaged.

Sec. 5-11.02. - Loitering: Duty of parents and guardians.

It shall be unlawful for the parent, guardian, or other person having the legal care, custody, or control of any person under the age of eighteen (18) years to allow or permit such minor person to violate any provision of this chapter.

It shall be unlawful for any person to assist, aid, abet, or encourage any minor person under the age of eighteen (18) years to violate any provision of this chapter.

Sec. 5-11.04. - Loitering: Presumption of aiding and abetting.

When any minor person is found violating any of the provisions of this chapter, a presumption shall arise that the parent, guardian, or other person having the care and custody of the minor person allowed, permitted, assisted, aided, abetted, and encouraged such minor person in such violation.

Sec. 5-11.05. - Loitering in certain public places: Duty of proprietors.

It shall be unlawful for any proprietor, keeper, clerk, or any other person having charge or control of any cafe, tavern, restaurant, bar, eating place, drive-in restaurant, or public dance hall in the City to permit any person under the age of eighteen (18) years to loiter in such public place between the hours of 11:00 p.m. and sunrise immediately following, unless such minor person is accompanied by a parent, guardian, or other person having the care and custody of the minor person.

Each owner, agent, manager, or keeper of a hotel, boardinghouse, lodging house, tenement house, motor court, or apartment house shall immediately report to the office of the Chief of Police the presence therein, between the hours of 11:00 p.m. and sunrise immediately following, of any minor person under the age of eighteen (18) years, unless such minor person is accompanied by the parent, guardian, or other person having the care and custody of the minor person, and, in making such report, shall state to the office of the Chief of Police the name, age, and last-known place of residence of the minor person and the names and residences of the parents, guardian, or other custodian of the minor person so far as such information can be ascertained from the minor person or otherwise.

Sec. 5-11.07. - Violations: Arrests.

Whenever any minor person is arrested for the violation of the provisions of this chapter, he shall be taken forthwith to the San Mateo County Juvenile Home, and the arresting officer shall immediately advise the person in charge of such institution the reason for the arrest of the minor person, together with complete details of the circumstances surrounding the arrest.
