13.04.030 - Area to be served.¶
The area served by the water and sewer systems shall be all territory within the boundaries of the city and such other premises as meet any of the following conditions:
A.
The owners of the premises have signed agreements to annex to the city; or
B.
The premises are commercial, industrial or institutional in nature and the council shall first have approved the application therefor. The approval of such application may be upon the condition that the owners of the commercial, industrial or institutional premises sign agreements to annex to the city, and on such other conditions as the council may determine; or
C.
Premises located within territory which is of such an unusual nature that, in the determination of the council, the annexation thereof would create an undue burden upon the city and yet which is entitled to sewage service as being within the region to be served by the city's sewage system, acting as a regional sewage disposal facility.

13.04.040 - No free service.¶
No facilities or services of the water or sewer systems shall be furnished to any premises or to any owner or other person free of charge, except the city. Any owner, other person or entity taking water from the city's water service without prior city authorization approval shall be subject to a fine set forth in the city's water and sewer rate schedule. This fine shall be subject to all of the collection and lien procedures set forth in this chapter.

13.04.050 - Separate connections required.¶
Separate premises under single control or management shall be furnished the facilities and services of the water system through separate individual connections. Separate connections shall be in accordance with the California Plumbing Code.

13.04.060 - Operating rules.¶
A.
The city council shall adopt, by resolution, a set of operating rules and regulations for each of the water system and sewer system. Such rules and regulations shall be revised from time to time, as deemed necessary by the council, with all revisions adopted by resolution.
B.
Violation of such operating rules and regulations shall constitute a violation of this chapter.

13.04.070 - Service discontinuance for violation.¶
In the event of violation, other than nonpayment of billed service charges, of any provision of this chapter, or of the operating rules and regulations, the director may shut off the water service and disconnect the sewer service to any premises, after first notifying in writing the person causing, allowing or committing such violation. Such notice shall specify the violation and, if applicable, the time after which (upon failure of such person to prevent or rectify the violation) the director will exercise his authority to disconnect the premises from the water and sewer systems; provided, however, that such time shall not be less than five days after the date of presentation of such notice; provided further, however, that in the event such violation results in a public hazard or menace, then the director may enter upon the premises without notice and do such things and expend such sums as may be necessary to abate such hazard, and the reasonable value
of the things done and the amounts expended in so doing shall be a charge upon the person so in violation.

13.04.080 - Service discontinuance for nonpayment.¶
Upon failure of the owner of any premises to pay any billed water or sewer service charges prior to delinquency or if the owner or occupant of any premises shall violate any other provision of this chapter, any one or more of the following actions authorized by this section may be taken by the city to enforce such payment:
A.
In each case where any bill for water or sewer service remains unpaid after such bill becomes delinquent, and such delinquency shall continue for a period of thirty (30) days, the city shall authorize disconnection of the premises from the water and sewer system, subject to the giving of five days' notice as provided in Section 13.04.070. Whenever premises have been disconnected from the sewer or water system for nonpayment of service charges, such premises shall not be reconnected to the systems until all delinquent and current charges have been paid and until a connection permit has been obtained and until such of the following charges as are applicable shall have been paid: a sewer disconnection fee equal to the actual cost to thecity of such disconnection, a water disconnection fee equal to the actual cost to the city of such disconnection, a sewer reconnection fee equal to the actual cost to the city of such reconnection, and a water reconnection fee equal to the actual cost to the city of such reconnection; and until the owner or occupant of such premises shall otherwise have complied with this chapter.
B.
In each case where premises are disconnected from the water and/or sewer system, the council shall cause the city to take, or to request any authorized public officer to take, such steps as may be legally taken to prohibit occupancy of such premises until they shall be reconnected to the water and/or sewer systems.

13.04.090 - Enforcement remedies cumulative.¶
The city, the council and all proper city officers, agents or employees shall promptly, efficiently and economically take all steps, actions or remedies necessary for the collection of charges as provided in this chapter which are now or may hereafter be provided for in law. Such remedies for collecting and enforcing such charges are cumulative and may be pursued alternately, or any thereof may be used consecutively when the council so determines.

13.04.100 - Refusal of service.¶
The city may refuse to furnish water or sewer service, and may discontinue all services, to any premises where apparatus, appliances or equipment using water is found by the director to be dangerous or unsafe,
or where the use of water on such premises is found by the director to be detrimental or injurious to the sewer or water service furnished by the city to other premises, or where the director finds that negligent or wasteful use of water exists on any premises which affect the city's services. The city shall have the right to refuse or discontinue service to any premises if necessary to protect itself against fraud or abuse.
