Chapter 12.12 — OBSTRUCTIONS

As used in this chapter:

"Obstruction" means any item which impedes or obstructs substantially, the sidewalk so as to prevent or deter the uninterrupted flow of pedestrian traffic.

"Sidewalk" means that strip of property in commercial and residential areas of the city which is used as a conveyance for pedestrians, or if unconstructed that path or property which would normally be traveled upon by pedestrians.

"Substantial impediment" means a seventy-five (75) percent or more interference with the entire sidewalk which prevents normal pedestrian traffic.

It is unlawful for any persons to obstruct or otherwise impede pedestrian traffic on any sidewalk or like strip of conveyance for pedestrian traffic in the city, except as provided in this chapter without a permit. Telephone poles, mailboxes, or other like objects shall not be considered to be in violation of this code section.

Permits to utilize sidewalks in a manner inconsistent with this chapter (e.g., sidewalk sales) are obtainable from the chief of police.

It is unlawful for any person to load or unload merchandise, goods or wares, except at the back or side door of the store or establishment where such goods are sold. All sidewalks shall be kept clear, at all times, except as provided in this chapter, for a distance of four feet from the edge of the sidewalk on the street side. All sidewalks shall be kept entirely clear and free of obstruction during the hours of midnight to six a.m. daily.

Doors in sidewalks used to cover an opening for an elevator, stairway or chute must be kept in such a condition that they will not endanger persons or property, and it is unlawful for any person owning or being in charge or control of any such doors in sidewalks used for covering entrances to elevators, stairways or chutes, or other openings in the sidewalk leading to the basement, to allow such doors to remain open, except when such elevator, stairway or chute is being used for loading or unloading or transferring of merchandise or materials.

Violation of this chapter shall be punished by a fine for a first offense of seventy-five dollars ($75.00), any subsequent offenses shall be fined with successive increases in the amount equal to seventy-five dollars ($75.00).
