Chapter 13.16 — IMPROVEMENTS IN ANNEXED TERRITORY

13.16.010 - Purpose.

The purpose of this chapter is to provide for the development of the economic, industrial, commercial and residential growth of the city by encouraging outlying areas adjacent to the corporate limits of the city to become annexed to the city and to provide for the extension of storm drains, sewer and water mains, lines and facilities to such territories and the construction and improvement of streets, sidewalks, curbs and gutters within such territories, upon annexation at a fair and reasonable cost and expense to property owners within such territories, but without casting an unfair burden of cost and expense upon the general fund of the city.

13.16.020 - Extension and construction.

At any time after the annexation of territory to the city, the city may construct, extend and maintain storm drains, sewer and water mains, lines and facilities to and within such annexed territory, and may extend, construct, improve and maintain streets.

13.16.030 - Charges and fees for construction.

Upon construction of any of the facilities or improvements referred to in this chapter, the treasurer of the city shall charge and collect a fee from any property owner within the annexed territory who desires such facilities or improvements, and who has not theretofore contributed fair and reasonable pro rata share of the construction and extension costs thereof. The amount of such charge and fee shall be fixed by the city council but shall not exceed such property owner's fair and reasonable pro rata share of the construction and extension costs of such facilities or improvements as the same is determined by the city council. The charges and fees to be fixed by the city council and collected by the treasurer shall be in addition to any other storm drain, water, or sewer connection or service charges fixed in accordance with other rules, ordinances or regulations of the city.

13.16.040 - Collection of fees.

Any or all of the charges and fees fixed in accordance with provisions of this chapter shall be collected by the treasurer, as directed by the city council, in a lump sum; or, in monthly or other periodic installments in connection with, and upon the same billings for, the collection of water rates and tolls of the city water department; or, on the tax roll in the same manner as general taxes; or, in the manner prescribed by Article 4, Chapter 6, Part 3, Division 5 of the Health and Safety Code of the State of California, or as the same may be amended; or, in such other manner as the city council shall determine and prescribe.
