Article I — Purpose and Definitions

This chapter is enacted for the purpose of adopting standards, regulations and procedures for the use and operation of, connection to and extension of the city water and sewer systems, and to establish fees and charges for service and connections.

The following terms, when used in this chapter, shall have the following respective meanings:

"Acreage" means gross acreage of real property, excluding existing public streets.

"City engineer" means the person so designated by the city council.

"Commercial use" means any land use which is not residential, industrial or institutional.

"Director" means the director of public works of the city, as designated by the city council.

"Domestic sewage" means the waterborne wastes derived from the ordinary living processes and of such character as to permit satisfactory disposal, without special treatment, into the sewer system.

"Dwelling unit" means any dwelling of one or more rooms, having one or more plumbing fixtures, suitable for residential occupancy by any number of persons living together as a single family, including single- family dwelling structures and each group of rooms constituting a dwelling unit for a single family in any multiple-dwelling structure.

"Family" means any one or more persons comprising a single-family unit.

"Front footage" means the dimension of that portion of a lot or parcel of land abutting a public street or proposed public street.

"Industrial use" means any land use in which any manufacturing activity is involved, including the manufacturing or processing of agricultural products, animals, poultry, goods, wares, or other products or materials.

"Industrial waste" means any and all liquid or waterborne wastes from any industrial or commercial processes, except domestic sewage.

"Institutional use" means any use of land by any public or private owner, including any public corporation, for operation of a public or nonprofit school, college, church, hospital, lodge, club, fire department, library, memorial building or other public or nonprofit activity.

"Lateral sewer" means that part of any sewer piping beginning at the junction thereof with a building plumbing system at not closer than two feet outside the foundation wall of the building serviced and terminating in any main sewer.

"Main extension" means the extension of any water main, main sewer or main trunk sewer, by construction of additional length thereof, beyond existing facilities in streets.

"Main sewer" means any sewer constructed in any street to accommodate more than one lateral sewer.

"Main trunk sewer" means any sewer constructed in any street to accommodate a system of main sewers.

"Multiple-dwelling structure" means a structure containing two or more dwelling units in any single building or structure or group of buildings or structures, including any apartment house or apartment court, but excepting dormitories, boardinghouses, hotels and motels.

"Occupant" means any person actually occupying any premises, whether as owner or tenant or under contract or otherwise.

"Owner" means the person owning fee title to any premises, as shown by the official records of the county recorder.

"Person" means any person, firm, company, corporation, partnership, association, or any public corporation.

"Premises" means any lot, place or parcel of land, or any building or other structure or any part of any building or structure used or useful for human habitation or gathering for carrying on a business or occupation or any commercial or industrial or institutional activity.

"Public corporation" means the city or any political subdivision, city, county, district, the state, or the United States of America, or any department or agency of any thereof. The singular in each case shall include the plural.

"Residential use" means any use of land for solely residential purposes by one or more persons.

"Sewage" means any liquid waste containing animal or vegetable matter in suspension, including liquids containing chemicals in solution.

"Sewage service" means the services and facilities for collection, treatment and disposal of sewage furnished or made available to premises by the sewer system.

"Sewer system" means the municipal sanitary sewer system of the city.

"Street" means any public highway, road, street, avenue, alley, way, easement or right-of-way.

"Utility services" means all utility services that the city provides or otherwise makes available for use and/or bills for under the provisions of Title 13 of this code, including water and sewer service.

"Water main" means any water pipeline constructed in any street to accommodate more than one water service line.

"Water service" means the provision of potable water, under pressure, to premises by the water system.

"Water service line" means that part of any water piping beginning at the junction thereof with a building plumbing system at not closer than two feet outside the foundation wall of the building serviced and terminating at any water main.

"Water system" means the municipal water system of the city.
