Article 6 — Maximum Number of Residential Allotments for the Construction Year

§ 10-6.601. Residential development allotments—Setting—Proration.

  • (a) The number of residential development allotments assigned shall be limited as set forth herein to only allow a total population increase per year in the City equal to five-tenths of one percent of the base year population of 8,000 or approximately 40 additional persons per year. The following formula shall be used, together with current figures for the population of the City and the number of persons per household obtained from the DOF as of January 1 of each year, to determine the number of allotments for the current year:

Allotments = Population of the City ×0.005 ÷ Persons per Household

Exhibit "A" attached to Ordinance 769 and made a part hereof sets forth a projection of the total population and dwelling unit increase permitted by the provisions of this chapter.

  • (b) The total allotments permitted for the first year of Title 10 , Chapter 6 (Residential Growth Management Plan) shall be prorated on a 12 month calendar basis beginning January 1.

§ 10-6.602. Monitoring of population and dwelling unit growth by Director.

The Director shall monitor and determine the population and dwelling unit growth within the City's boundaries and those areas described as the Ojai Valley in the AQMP and shall notify the City Council as to the results of such determination as part of the City Council's annual review pursuant to Section 10-6.604 . § 10-6.603. Housing mix.

  • (a) Allotments shall be made without regard to type of housing (i.e., single-family or multifamily).

  • (b) Beginning January 1, 2014, allotments which remain unallocated at the end of each calendar year (plus allotments that are not used within one year of their assignment pursuant to Section 10-6.804 (Residential development allotments—Maximum number limited)) shall be placed into a special allocation pool (and accumulated from year to year). Allotments within the special allocation pool may be awarded, at the discretion of the City Council, to Residential Projects which affirmatively further goals and objectives of the General Plan and Downtown Redevelopment Project (as such terms are defined at Sections 10-2.902 (Definitions) and 10-6.501 (Definitions)), including: (1) fostering mixed use development within the VMU zone district; (2) revitalizing blighted and underutilized property along Ojai Avenue; (3) promoting workforce housing and a jobs-housing balance to reduce vehicular trips; and (4) low-impact development that affirmatively furthers the character and quality of the community.

§ 10-6.604. Annual review.

Population increases, actual residential construction, including residential units exempt from development control, the population per dwelling unit, progress toward attainment of air quality standards and the economic ability of the community to provide increased public services both within the City and for the Ojai Valley as of January 1 of each calendar year shall be reviewed every year by the City Council on or about June 1 of each year. Thereafter, the City Council shall determine the number of allotments and residential building permits permitted for the following calendar year. The formula for allotments for future years may be adjusted by amendments to this chapter.
